NASHVILLE, Tenn. (WZTV) — A Tennessee bill that would authorize the death penalty as a punishment for rape of a child sits on Gov. Bill Lee's desk.
This bill allows prosecutors to go after the death penalty when it comes to heinous crimes against children, like sexual assault of a child under the age of 12. It passed both the House and the Senate last month.
Legislators say the person convicted would have to be 18-years or older. Supporters believe this would act as a deterrent. Critics say it might make it harder for the victim to come forward, especially if it's a loved one.
Republican Rep. William Lamberth disagrees, reading a letter from a victim.
“Since he was my grandfather, I would agree to the death penalty. Even for him. He molested many generations. And this needs to stop,” Rep. Lamberth said.
But others believe different measures can be taken.

Death penalty “available” doesn’t mean it will be applied in every case.
When you have a kid-raper dead to rights ... no doubt about who did it and to whom ... DP is not unreasonable.

My recollection is that the Supremes outlawed the death penalty for this in a case out of Louisiana a few years ago. So this is just political pandering at this point.
Found it. Kennedy v. Lousiana, 554 US 507 (2008). No dead body, no death penalty to oversimplify the ruling.

I suspect the current Scotus would have no problem overturning its 2008 decision.
These laws sound so tough and conservative. However, in practice they cause added suffering and death to innocent victims. They provide legal incentive for child rapists to murder their only witnesses, their victims.
Why wouldn’t a child rapist just murder his victim?
They already do.
Even if they murder the kid there is still the DNA to convict.
Criminals don't deserve mercy just because they're not very good at their chosen profession.
