Here’s Why Alvin Bragg's Case Against Donald Trump Is Collapsing
PJ Media ^ | 04/26/24 | Matt Margolis

Posted on 04/26/2024 3:26:18 PM PDT by SeekAndFind

District Attorney Alvin Bragg’s case against Donald Trump was always weak if not meritless. But that didn’t stop him from pursuing a felony case for a low-level misdemeanor that normally would have resulted in a fine that was also past the statute of limitations.

Be that as it may, Bragg’s weak case has taken some real hits on Friday, as the testimony of David Pecker, the former publisher of the National Enquirer, has been devastating for the prosecution. In fact, according to George Washington University law professor Jonathan Turley, Bragg’s case is now “collapsing on its own weight."

"They have a witness who was disassembling in front of them,” Turley told Fox News on Friday. "You know, the prosecution never revealed to the jury in the direct that Pecker actually had killed stories for other celebrities that he had been working on stories two decades before the election with Trump that he was suppressing."

This is particularly helpful to Trump’s case because it means that the prosecution can't directly link Trump’s efforts to quash the Stormy Daniels story to the election.

"And now it's only getting worse,” Turley continued. “Yesterday was really bad in terms of the cross-examination for the prosecution. Today is much worse."

Pecker is saying that Trump didn't want to purchase the story. Yesterday he said that when he asked Trump while reimbursing Cohen he said he didn't know anything about that. I mean, we've always — already been complaining about the lack of any recognizable crime here, but there's also a dwindling connection to Donald Trump himself. That is what we're really seeing here is a lot of discussions with Michael Cohen, who's going to give us a really memorable moment when he gets on the stand.

That's why the Trump team will seek a motion to dismiss before putting on its defense

It is standard procedure for the defense to move for a directed verdict/acquittal/demurrer at the close of the state’s case. In some jurisdictions, failure to make this motion precludes the defense from making the motion (again) at the closing of the case.

Just about every defense seeks a motion to dismiss.

Who cares. In the end this all comes down to the election. If Trump wins it’s done and if he loses he’ll spend the rest of his life in prison (they’ll find a way to do it, doesn’t matter the case of the law). That’s why the people love him. He has risked it all foe the country.

Is there any way Trump can sue for damages?

I’ll believe it IF I see it.
The other side has everything and we have nothing.

We can’t win, Scully. We can only hope to go down fighting.

Some might say they only care about sending him to prison if he wins, not if he loses.

It’s New York City.

Bragg could break down and tell the jury his whole case is rubbish and they would still convict

I know, but they mostly get denied because it's always expected that the defense will do that.

In this case, do you guys think that Merchan will deny it too, even if it is overwhelmingly obvious that Bragg failed to make his case?

He knows that will mean the jury will never get to deliberate and possibly have a "reverse jury nullification," which is going to be the Hail Mary that the Democrats are hoping for.

Just how far do you all think that Merchan is willing to go to "Get Trump?" Is he a true believer who is willing to throw away his career and ruin the reputation of the legal system in New York City? Does he believe that in New York he's free to abuse the law as far as it takes to Get Trump and there won't be any consequences to him because it's what the system wants and who's going to stop them?

If all the experts across all the media believe that Bragg failed to make his case, will Merchan still make Trump put on his defense in order to keep him tied up in court spending money and losing campaign time?

If Merchan did that, would it be a violation of Trump's sixth amendment right to a speedy trial? If Merchan did that, would anybody care?

I saw an article earlier today from the agenda-driven media that says the case is in slam-dunk great shape for the prosecution.

I still expect a guilty verdict regardless of what happens because Kangaroo Kourts don’t often actually consider the case, only the agenda.

I am NOT a lawyer but I think Trump’s attorney should start his cross examination by asking Cohen if he’s ever been convicted of perjury. When he answers that he has been I’d move to have him removed from the witness list. When the judge disallows that I’d file a formal objection to his presence at trial.

Unfortunately, that reputation means very little to Bragg and co. He is going to be paid no matter what. And Merchan? If anything, he will probably be in the NY doghouse for being too easy on Trump (by their "standards").

No it’s not…the rat jury will see to it! Pipe dreams that’s all our side does is talk and dream! We are dealing with demons that don’t give a CHIT! Truth be damned! The integrity of the judicial branch no longer exist in this nation. The judges use the constitution as toilet paper now. This is how Hitler regime ruled Germany by using the college idiots and the judicial branch to be his brown shirt Nazi left hand to do his evil bidding. That’s why it was easy for them to murder 6 million Jews and other nationalists including christian who were hiding jewish families from hitler’s death camps!

Yeah we all know all these trials against Trump are bogus, yet they all persist, and Trump keeps getting deeper in the hole every day.

Sondergerichte.

Judges in Nazi Germany were then instructed that in the event of any conflict between the Nazi Party and Law, the Nazi Party should always succeed as their objectives surmounted any notions of fair play.

Merit has been wiped from the left’s vocabulary

Correct. The activist left does not believe in the traditional measure of merit as being effective in accomplishing results.

They limit merit to how effective the actions are in furthering the revolution.

Judge can still put President Trump in jail for failing to comply with the gag order. Even if President Trump is not found guilty for the trial he may just end up in jail anyway.
