The man who choked a homeless person to death in a New York City subway last year is set to go to trial in October, a New York judge determined Wednesday.
Daniel Penny pleaded not guilty to second-degree manslaughter and criminally negligent homicide in the May 1 death of Jordan Neely, who was reportedly had a mental illness. Penny put Neely, a subway performer, in a fatal chokehold after he had been reportedly shouting at passengers and behaving erratically.
The case attracted attention in political circles, sparking racial justice protests. An online fundraiser raised more than $3 million for his legal defense.
Prosecutors said Penny, a former Marine, placed Neely in a chokehold that “continued well past the point at which Mr. Neely had stopped purposeful movement.”

The article says he was shouting and acting erratically at fellow passengers. They don’t mention that he was threatening their lives.
New York only has a few decent people today.

Problem: The New Yorkers can respond to their environment by degenerating and they have.
I doubt there are enough good humans left in New York.
BS. No way a unanimous jury convicts this guy. Each and every juror will be able to put themselves in his place. I’d lay a grand he beats the rap
I hope he has competent counsel... preferably pro bono or covered by a GoFundMe or equivalent.
The “jury of his peers” will be all black with room temperature IQs whipped into a frenzy by a prosecutor comparing him to Derek Chauvin.
Will be convicted in 15 minutes.
New York needs to be kicked out of the Union, and let the thugs of the world prey on the ruins.

Concur. There is no way a NYC jury of subway riders would convict this guy particularly in light of all the recent incidents. This trial is a waste of taxpayer $$$. This guy deserves a medal.
If the trial is being held in Manhattan chances are crazy liberals on the jury are going to take the initiative to make sure Penny gets a guilty verdict. Look at all the stacked juries Trump and his associates have had to face. We live in a different world now and Penny can’t count on a fair trial.
The best chance for Penny is to get a change of venue to Staten Island or an outside of NYC jurisdiction. Or a bench trial if his judge isn’t a deranged leftist.
Bingo. The DA is going to get a jury full of people who can be easily manipulated into a guilty verdict for Daniel Penny. Lord knows there are enough black people and liberals in New York City to make it happen.
We can’t count on the court system to save us anymore.

I completely understand why Penny took this course of action, and would do the same myself most likely. The problem is that a choke hold or carotid restraint is now considered lethal force by many jurisdictions. When someone dies from its use, the law of bad outcomes comes into play and even police officers using the hold in the line of duty are often charged with some level of homicide. See Minneapolis or the cigarette guy in NY for examples.
