The MAGA-friendly federal judge who keeps siding with Donald Trump in his Mar-a-Lago classified records case has forced prosecutors to make a stark choice: allow jurors to see a huge trove of national secrets or let him go.
U.S. District Judge Aileen M. Cannon’s ultimatum Monday night came as a surprise twist in what could have been a simple order; one merely asking federal prosecutors and Trump’s lawyers for proposed jury instructions at the upcoming trial.
But as she has done repeatedly, Cannon used this otherwise innocuous legal step as yet another way to swing the case wildly in favor of the man who appointed her while he was president.
Department of Justice Special Counsel Jack Smith must now choose whether to allow jurors at the upcoming criminal trial to peruse through the many classified records found at the former president’s South Florida mansion or give jurors instructions that would effectively order them to acquit him.
Alternatively, Smith could appeal to the Eleventh Circuit Court of Appeals, where more experienced judges have already overturned Cannon and reined her in. But doing that will only further delay a trial that’s at least three months behind schedule, entirely by the judge’s own design. (She froze the investigation and tried to slow-roll document review until the appellate court forced her to stop.)

On the same day that SCOTUS blocked enforcement of the Texas sovereignty bill, it denied cert to the Indiana couple who had their child stolen for not using transgender pronouns. Once again, the federal courts are a one-way street and a dead end. They will always countermand our political gains in the states, but then in the states where the political system violates our rights, they will never be there for us. Only for the illegal invaders.
When alleged national security-related documents or testimony are involved in criminal cases, the due process rights of the defendant trump the prosecutors desire to keep them away from the jury.
This falls within the definition of “graymail”.
This is very common when prosecuting individuals who are associated with alleged crimes by individuals involving state secrets.
I doubt Judge Cannon just pulled this order out of thin air. Jack Smith and Trump’s attorneys must have known this order was coming out today. Judge Cannon put the ball in Jack Smith’s court and let him make the decision.
You can bet your last dollar that the DOJ and Biden White House knew this order would be coming down.
The case law is clear that the jury must be presented with the documents that allegedly violated a criminal statute. It is so clear, that no Court of Appeals is going to reverse.

IMHO, he was probably hoping to show the redacted photos the FBI took of some folder on the floor, etc. ans say it was so sensitive, we had to redact the whole thing, here, just look at this page of blacked out text, and flash it in front of the jury and claim it was in the folder. Now, convict him, nowwwwwwwww!!!!!!!

What is to say the FBI/CIA/CDC/FFA/FCC/DOJ/BLM or whatever slips in documents that Trump never ever had. Who is going know the truth?

ALL that we have “seen” (been told by the prosecutor) as “evidence” so far is a leaked photograph of empty folders on a piece of carpet.

I’m still waiting on the evidence of from Jan6 that put hundreds of law abiding citizens in prison for taking a white house tour.
The writers lament that the judge “MAGA friendly” is a tacit administration that its a political prosecution.
