Yes the majority held legislation is necessary. That Barrett wouldn’t sign on to that is troubling. Hopefully her reasoning is purely that she didn’t feel that issue was before them.

Today, the majority goes beyond the necessities of this case to limit how Section 3 can bar an oathbreaking insurrectionist from becoming President. Although we agree that Colorado cannot enforce Section 3, we protest the majority’s effort to use this case to define the limits of federal enforcement of that provision. Because we would decide only the issue before us, we concur only in the judgment.

They are already planning the next move.

Trump appointed Justice Amy Barrett concurred in the specific case against Trump.

However, she challenged the broader agreement that Section 3 of the Amendment can only be enforced through federal - not state - legislation.

Not sure what Barrett is up to.

My first guess - she supports some circumstances where states can enforce the amendment against Conservatives and Republicans, but not against Democrats.

The court sided with the people and our right to choose, and not the side of democrat liberal fascist dictators who want to tell us who we cannot choose.

What did they expect? The same thing would happen to Biden. And even if it didn't, if Biden were reelected, “election deniers” would have a legitimate reason to question the election and worse, refuse to accept the results.

What they were too stupid to figure out, is that they need all Americans to accept the election results. Well maybe a majority. Not good when 10s of millions of Americans don't trust the electoral process. The country will collapse into civil war soon after.

Barrett’s concurrence basically says, “Why can’t we all get along?” and declines to say much at all. I think that’s a bit ominous for other divisive issues.

It is worth noting that the Supreme Court has ruled what Democrats did in Colorado was not constitutionally valid.

The 9-0 vote stopped the Democrat attempt to violate President Trump’s rights, and the rights of voters.

The Supreme Court stopped, at least this one, Democrat attempt to interfere in the 2024 election.

She seems to be suggesting that congress can enforce the provision by some act other than “appropriate legislation” which the amendment calls for. Such as just refusing to seat the president without existing legislation allowing them to do so.

Election Predictions forecasts 3 of 4 Maine EC votes going red, so she may be in her last term. It was quite embarrassing for her and Maine.

What kind of crackpots are you electing up there ? I’d think sane Mainers would want her gone.

The concurring opinion by the 3 leftist Justices is outrageous. They use the term “oathbreaking insurrectionist” multiple times, knowing full well the media will cite that language. They also cite Dobbs (an abortion case) and Bush v. Gore. Freakin’ hacks.
