The Supreme Court is set to issue a ruling on Trump’s ballot eligibility after he challenged a decision by the Colorado Supreme Court to bar him from the 2024 primary ballot.
In December the Colorado Supreme Court disqualified Trump from the 2024 ballot.
All 7 Colorado Supreme Court justices were appointed by Democrats – 3 of the justices dissented to the ruling.
The legal theories are based on Section 3 of the US Constitution’s 14th Amendment which states public officials who have “engaged in insurrection or rebellion against” the US may be disqualified from public office.
Trump has not been charged with engaging in insurrection or rebellion against the United States.
Oral arguments before the Supreme Court on Trump’s ballot eligibility wrapped in early February.
The Supreme Court expressed skepticism as they heard arguments from Colorado lawyer Jason Murray. Even the liberal justices expressed concern.
“Why should a single state have the ability to make this determination not only for their own citizens but for the rest of the nation?” Justice Kagan asked.

“The legal theories are based on Section 3 of the US Constitution’s 14th Amendment which states public officials who have “engaged in insurrection or rebellion against” the US may be disqualified from public office.”
That is a rather incomplete and misleading summary of what the 14th Amendment states.
My guess either 9-0 or there will be one commie who rules against Trump. Trump’s name is still on the ballot in Colorado, so if the court was going to rule against Trump they would have done so weeks ago so new ballots could be issued..it was obvious by the way the justices were questioning the lawyers which way they will rule. they are coming out tomorrow with the ruling since Tuesday is Super Tuesday
I’m ready!
One would think so, and hats off to Justice Kagan for axing the obvious question.
The 14th also gives Congress enforcement powers. Not state courts or election officials.
I was just about to post that I had heard rumors that the decision on the ballot issue would be released tomorrow. I’m hearing it from several sources but wasn’t sure where those sources are getting that information. I don’t see where SCOTUS had updated their calendar but I assume Gerstein has information that they have added an opinion day for tomorrow morning. To add an opinion session on such short notice for a Monday does indicate that an important and quickly made (probably 9-0) decision is going to be released.
Prepare for the usual gnashing of teeth and screams that the Supreme Court is illegitimate and needs to be increased to 15 justices.

Yep, it’s coming! 😀
That was great!
Now, where are the charges to remove Biten, with his invasion operation insurrection?
Enforcement of the 14A resides in Congress and nowhere else.
I’m betting 6-3
Thank you, and one has no idea. 🙂
Not to mention that, as Brandon said about college tuition waivers, they will do what they want to do anyway.
Jurists across the spectrum have thrown out the Law to illegally attack Trump. Will SCOTUS stand up for the Law? Or will they destroy the credibility of the entire Judicial system?
I’m betting 6-3
xxxxxxxxxxxxxxx
a 6-3 ruling could ignite the fear of dem/DS court packing if brandon or his stand in should be re elected.
Correct. We all know the 14th amendment was for the purpose of authorizing homosexual marriages.
MO: it wasn’t a insurrection. It was a rally that was infiltrated with left-wing Trump haters including any cabal on the ‘take’.
“needs to be increased to 15 justices.” I agree, but only if they are all real conservatives who believe in the US Constitution, not the European rag of the World Court.
Interesting that it’s “may be” and not “will be”.
Congress itself doesn't enforce the provision. It passes legislation providing for how it is to be enforced. No legislation means no enforcement.
If you have the power to do something you have the power to abstain. No one else receives that power in the vacuum created by Congress chosing not to act.
