Supreme Court justices indicate they’ll keep Trump on 2024 ballot in landmark case

WASHINGTON — A clear majority of the Supreme Court’s nine justices signaled Thursday that they would overturn a Colorado ruling barring former President Donald Trump from the state’s Republican presidential primary ballot.

The former president, 77, and his lawyers were appealing the Dec. 19 decision by Colorado’s Supreme Court that found Trump ineligible for the March 5 Republican contest by virtue of violating the Constitution’s so-called “Insurrection Clause” during the Jan. 6, 2021, Capitol riot.

Trump’s team argued separately that Congress — not the states — was tasked with enforcing the clause, that the provision did not apply to the office of president, and denied that the 45th president engaged in an insurrection by seeking to remain in office after his 2020 election defeat by Joe Biden.

During oral arguments, Chief Justice John Roberts fretted about the possibility that upholding the Colorado ruling would open the door to red and blue states removing politicians of opposing parties from the ballot on a whim.

“It’ll come down to just a handful of states that are going to decide the presidential election. That’s a pretty daunting consequence,” Roberts said.

I liked Alito’s question to Murray along the lines of:

“If a President gave money to a foreign country (unstated, but referring to Iran) would that be enough for a state to remove him from the ballot?”

I've been worried about an assassination attempt for months. And we have many more months to go.

I sure hope PDJT has the best personal security money and loyalty can buy. And I don't mean just Secret Service. I suspect before this is over, somebody is gonna have to take a bullet for him. The Left is murderous in their rage.

This particular case is a slam dunk Trump, because otherwise both sides are going to start kicking the others off all the ballots everywhere. The same provision lists “aid and comfort to our enemies as a disqualifier also”. Everything the Democrats have done in my life time meets that qualification to have ALL Democrats removed from the ballot everywhere.

This is why the supreme court will rule in Trumps favor.

Yup. Alito laid it on the line. If SCOTUS were to let Colorado get their way, Biden will be removed in GOP states for giving aid and comfort to Iran.

Sotomayor stuck out from all the other attorneys in the room, In My Non-lawyerly Opinion, as she stumbled with her thoughts and words with her time.

Plaintiff Attorney Murray copiously slathered on the verbiage of against Trump, as if he’d been convicted of being a criminal insurrectionist, when the regular order of criminal due process had been contested by the defense.

Presidential elections would forever be in upheaval if not the excuse for kinetic battle if the Colorado model were endorsed by SCOTUS.

At least one of the justices’ comments went toward immunity in a way that would support Trump. In an allusion to Barry’s having made a “diplomatic” call to send hundreds of millions to Iran and giving them a pat on the head with regard to the JCPOA language, seemed to confuse the two separate cases, but was a warning to Left that lack of immunity would result in similarly-tumultuous outcomes.

Time has shown that predicting how SCOTUS will rule based on anything but the final ruling is foolish, and often wrong.

Most of the Judges are hyper-political and vein, especially Chief Justice Roberts, who is more worried about "the reputation of the institution" instead of its Constitutionally defined function.

Just because SCOTUS told them to doesn't mean all the states will do it.



Because they know a Trump47 will put many tens of thousands of them out of their phoney-baloney jobs. And hundreds of them in jail.

Because you always can tell what larceny the demoncrats have in their hearts is because that's what they'll be accusing the Republicans of. And right now it's not the RIGHT who are the insurrectionists, it's the LEFT.

I doubt SCOTUS wants to open that can of worms - and would prefer not to interfere in the election process.

That said, I’m not holding my breath, I think this could go either way.
