Supreme Court justices indicate they’ll keep Trump on 2024 ballot in landmark case

WASHINGTON — A clear majority of the Supreme Court’s nine justices signaled Thursday that they would overturn a Colorado ruling barring former President Donald Trump from the state’s Republican presidential primary ballot.

The former president, 77, and his lawyers were appealing the Dec. 19 decision by Colorado’s Supreme Court that found Trump ineligible for the March 5 Republican contest by virtue of violating the Constitution’s so-called “Insurrection Clause” during the Jan. 6, 2021, Capitol riot.

Trump’s team argued separately that Congress — not the states — was tasked with enforcing the clause, that the provision did not apply to the office of president, and denied that the 45th president engaged in an insurrection by seeking to remain in office after his 2020 election defeat by Joe Biden.

During oral arguments, Chief Justice John Roberts fretted about the possibility that upholding the Colorado ruling would open the door to red and blue states removing politicians of opposing parties from the ballot on a whim.

“It’ll come down to just a handful of states that are going to decide the presidential election. That’s a pretty daunting consequence,” Roberts said.

I won’t try to predict how Kagan is going to rule on this case; but she is by far the most intelligent of the three Dem justices (aka The Weird Sisters: hat tip to Shakespeare and Macbeth).

If it was a rat the US SC would have overturned the CO SC 2 hours after their decision. That traitor Roberts sounds like he is worried red states would toss Biden so he’ll overrule CO because of that.

Trump will win win 9-0 but they will leave open the argument as to whether could refuse to seat him if and when he wins based on the insurrection argument.

I would be very surprised if it’s 9-0. Sotomayor has had moments of clarity, but not so much when Trump is involved. And Jackson, not a chance she would vote for anything that favors Trump.

I wouldn’t trust Roberts. He might say one thing but when it comes down to it he’s compromised.

I agree with you. Kagan might not know what a woman is but she seemed to understand the chaos that affirming Colorado’s ruling would bring. I’m still a little shocked.

I celebrate nothing until it is a done deal. We’ve been down this road before where we think the constitution steadfast in its law and then whammo! Look at what they did to us in Texas! I’ll wait until they rule before I start popping any champagne corks! I have become so skeptical I trust nothing I trust nobody, especially the judicial branch. They have literally destroyed a once beautiful, fair, full of freedom nation. But someday what they have done to Trump, and to the J6 folk and the American people will come back and bite them in the ass! Someday!

Nah. 9-0 on narrow grounds, probably on the lack of enabling legislation. The decision is already made and the libs’ questioning was just for show. Permanently closing the door on this is too important to the stability of the electoral system and could literally lead to a hot civil war. Maybe concurrences that work Trump over a bit so the lib maniacs in the populace can have their sads salved a little bit
