DENVER (AP) — The Colorado Supreme Court on Tuesday declared former President Donald Trump ineligible for the White House under the U.S. Constitution’s insurrection clause and removed him from the state’s presidential primary ballot, setting up a likely showdown in the nation’s highest court to decide whether the front-runner for the GOP nomination can remain in the race.

He’ll win by “write in” vote. Lieberman did it in the senate some years ago. Lieberman, a long time dimocrat senator, pissed off the dim party and they primaried him with a left wing radical. Liberman ran as an independant and won.

Not only did they not have evidence for his case in NYC, there was no victim, no fraud and the bank stated that they weren’t defrauded.

The lady accusing him of rape in NYC does t remember when it happened, they had to enact a law just to allow her case, her interview with Cooper was fit short because she said rape was erotic, or something like that, and Pres Trump was t allowed to present any evidence.

That’s just two, so far.

Have no idea.

When everyone casts a write-in ballot for him, then what? They can’t force folks to vote for a certain person.

The odd thing is, these people have zero shame. Right now, somewhere they’re all patting themselves on the back. “We got him now”.

The U.S. Supreme Court will rule that Trump wasn’t given due process (no conviction on insurrection) and will overrule the Colorado Supreme Court’s decision.


You are one of the few Freepers who actually seems to understand the issue.

The 14th amendment clearly defines Congress as the body that decides this.

States may control the manner of electing Electors, but they don't have 14th amendment authority to decide insurrectionist bans.

Please tell me where in the Federal Constitution there is anything about “running for President”, “voting for President”, “Presidential elections”, or anything similar.

For that matter, where does it specify that the President appointed by the State Legislatures is “an officer under the united States”? It does include Electors under XIV but not the President.

There were very specific reasons why the national government was given no role in replacing a sitting President, a power reserved to the State Legislatures (through the appointment of Electors).

Yep. 14th may well allow disqualification without conviction. And SCOTUS will probably want to avoid involvement.

I think it’s important that Colorado recognizes the Constitution of the United States. According to what I am seeing on Fox News, Colorado Supreme Court thinks the Republic does not belong to the people. Oh,really? Is Colorado saying they are not part of the Union & are a separate, independent & completely sovereign state?

I don’t care what state it is, they can’t take away his right to due process. Until he’s convicted of insurrection, they can’t take him off the ballot for it.

It doesn’t matter if Trump committed insurrection or not, the 14th amendment can not be used to ban him. It only applies to electors for President and vice president, not for the President itself. Drafts of the 14th amendment exist which included the President but the final version does not, so that immunity is intentional.

The 14th amendment also applies to officers of the USA but the Supreme Court already ruled elected officials including the President are not ‘officers’ which are unelected people hired for their respective positions.

In other words this is all B.S. ant the insurrection clause can not be used.

It is a ridiculous ruling. If states had the power to arbitrarily bar certain candidates from the ballot then there is no reason that, as an example, Florida and Texas couldn't just bar Joe Biden or whoever is the Democratic party nominee from the ballot in those states.

Who knows, maybe a state can just pass a law that voters can only choose from one party's candidate on election day, and that is the Republican party.
