Supreme Court Justice Samuel Alito said that he has a “pretty good” idea who was behind the leak of the court’s decision on overturning Roe v. Wade — and that the leak made the justices targets for possible assassination.
Alito, who authored the landmark Dobbs v. Jackson Women’s Health Organization decision that ruled there is no constitutional right to abortion, made the comments in an interview with The Wall Street Journal.
“I personally have a pretty good idea who is responsible, but that’s different from the level of proof that is needed to name somebody,” Alito said: “It was a part of an effort to prevent the Dobbs draft … from becoming the decision of the court. And that’s how it was used for those six weeks by people on the outside — as part of the campaign to try to intimidate the court.”
Alito said that the Supreme Court “did a good job with the resources that were available,” but said that the evidence was not strong enough for an official designation of guilt.
The conservative justice added that the leak not only brought an environment of “suspicion and distrust,” but also danger.
“Those of us who were thought to be in the majority, thought to have approved my draft opinion, were really targets of assassination,” Alito said. “It was rational for people to believe that they might be able to stop the decision in Dobbs by killing one of us.”
He also called it infuriating that some people believed a conservative justice may have leaked the decision. “Look, this made us targets of assassination. Would I do that to myself? Would the five of us have done that to ourselves? It’s quite implausible.”
The court was ultimately undeterred by the pressure and voted to overturn Roe.

The Marshal never interviewed the justices. All the other worker bees had to sit in and be interviewed or investigated. Now Alito says he thinks he knows who did it but chose not to tell the investigators, what a loser.
He said he didn't have enough proof to name the leaker, meaning publicly. He didn't say he kept that from the investigators.
Then you call him a loser. I think we know who the loser is here.
Proof required in court is greater than proof required to kill the leaker.

I met Alito and had a long candid discussion with him at an event. He is deeply religious and a fighter, remember he called out Obama during a State of the Union address. He is anything but a loser

He just said, by means of a question, that he and those of his colleagues that constituted a deciding majority in Dobbs are not responsible for the leak of the Dobbs draft. He has personally concluded who the leaker is, but being Catholic knows where the line is beyond which he could credibly be accused of calumny or at least detraction for parting with that personal conclusion. What more do you want from him?

I expected him to be a leader and defend his staff. Not only that, he chose not to be interviewed. He allowed his staff to get the gut punch.
You seem to be advocating for the abandonment of the rule of law.
Could you explain further please? From what you are saying it’s not clear he did anything wrong or failed to do the right thing.
At no point did he stand up and defend his staff. He allowed them to have their future potential hurt by such a environment that they couldn't be trusted, nor any other person working for the Justice's. Now, he puts his character out there saying he knows he did it, and didn't report it. He's a loser.
My guess is a law clerk leaked it after being instructed by a Supreme Court Justice. I think either Sotomayor or Kagan.
It does appear that he is deliberately and publicly leaving Roberts off of his short list (the five of us) of those Justices who should be considered above suspicion in terms of who leaked the draft. And it does appear that he is saying that he has personally concluded that one of the remaining four deliberately leaked the draft for nefarious purposes.
