“Critical Factual Error” by FBI Raid Affiant Could Blow Up the DOJ’s Case Against Trump

The sworn affidavit presented to secure the search warrant for Mar-a-Lago used by the FBI to raid Donald Trump’s home had what appears to be a crucial error in it, one that could be easily debunked. If the facts detailed by independent journalist Paul Sperry are accurate, this could be enough to obliterate the Department of Justice’s case against Trump.

In a post on Gettr, Sperry said:

BREAKING: The FBI affiant who swore to the Mar-a-Lago search warrant appears to have made a critical factual error by stating in the unsealed affidavit: “I do not believe that any spaces within the PREMISES have been authorized for the storage of classified information.” This finding, which is the linchpin of the criminal case vs. Trump, overlooks the fact that:

1) White House records confirm that a Sensitive Compartmented Information Facility (SCIF) authorizing the briefing and storage of classified material up to the TS/SCI level had in fact been installed at Mar-a-Lago; and,

2) records show that the Secret Service had recently awarded a nearly $600,000 contract to upgrade physical security within the premises at Mar-a-Lago for Trump’s post-presidency transition

Sperry later posted:

DEVELOPING: The unsealed FBI affidavit contains several oddities:

1. No where does it flat-out say “classified information” was found in Trump’s 15 boxes. On page 2, it refers only to docs “with classification markings,” which raises the specter they were no longer classified

2. It states the docs “appear” to contain National Defense Information. But agents “triaged” the boxes; they would know if they contain NDI or not

3. The affiant claimed “there is probable cause to believe evidence of obstruction will be found at the premises,” yet there’s no “obstruction” header or section spelling out why he believes this

4. He said he doesn’t believe “any spaces” w/in Mar-a-Lago are “currently” authorized for storage of classified info. So they were, but not “currently”?

This analysis appears to be accurate according to a former federal magistrate (name withheld by request) who reviewed both the redacted affidavit and Sperry’s claims.

It’s odd that the FBI would include such an easily debunked claim about appropriately secure storage areas on the premises on their affidavit. It should not have been necessary for their case if we are to believe they are trying to indict Trump for taking classified documents. By including it, they run the risk of tainting the predicate for the search warrant which could make evidence they collected during the raid inadmissible.

Everything about the raid and the case being built by the Department of Justice reeks of sloppiness and desperation. Are we seeing a Deep State plot blowing up or are we missing a deeper, darker agenda?

In our hyper-specialized culture what work does get done is usually done to perfection. So, what it reeks of is it was not done by the people who ordinarily would perform the work.

Exactly. That the FBI got a judge to act on it is the issue. A decent judge would have said’ “Get me some facts then come back and see me.”

SCIF. I have had access to a sensitive compartmented intelligence facility in both a contractor facility and a government facility. So a SCIF could be established in a former president’s home.

They needed the crossfire hurricane records to protect themselves, and information about what Trump was planning with his lawyers.

They already got both. The raid was a success in protecting illegal government, with illegal acts.

The raid is not the worst tactic that will be employed. I hope DJT’s vehicles are armored and some of his bulk is body armor and he does not fly on his own airplane much, though I think if the decision is made to end his career suddenly it won’t matter that there are a couple of hundred non-Trump people on the plane.

There are articles saying he had a storage room in his office above the ballroom and also near the pool area. The one in pool area is where they asked him to put extra lock on. It would seem to me that is not an authorized sci/ room. All his money and he couldn’t secure a better place for those documents. Just an observation. He could have built another building/or extended the basement secure storage area.

I hope his attorneys used the defense that as SOS Hillary had unsecured server/printer in a room in her house(closet) where her housekeeper use to get her papers off the printer.

Also she had a server in a bathroom closet at some IT company who had a business in an apartment loft that had no security.

Dan Bongino explained this well. When he was SS and traveling with a POTUS, the documents detailing the entourage route was in writing and clearly marked “Classified”.

After the event the info no longer was classified. The MARKINGS on the papers always will be there.

Anyhow, if Trump declared them unclassified before noon on 1/21/21n they are unclassified.

The one that smashed phones, wiped servers, had a bathroom closet for secure documents in an apartment of IT business who didn’t have any security.

Absolutely! Simple logic. So simple even a Democrat can understand it.

Trump is demanding that EVERYTHING be shown but they won’t do it. They’re covering their asses.

I think it was Posobiec who said they can’t legitimately use the excuse of hiding names of informants, because names of informants, even their undercover names, aren’t ever in these types of docs. Referred to as #1, #2, etc.
