J6 panel shuns live testimony from Trump associates, prefers to slice and dice taped depositions

House Democrats' Jan. 6 committee has been showing video clips at its hearings of previously recorded depositions from associates of former President Donald Trump rather than live public testimony.

Former Trump adviser Steve Bannon recently offered to testify in public, according to a letter written to the committee by his attorney Robert Costello. The committee has not yet responded to Bannon's offer to testify publicly.

Costello told Just the News that the committee prefers to make a "television moment consistent with their narrative" rather than risk the surprises inherent in live testimony.

"They do not encourage live testimony," Costello said in a statement. "Bernie Kerik was given a conditional waiver of attorney client privilege by President Trump if Kerik would be allowed to testify publicly. The Select Committee declined. The reason they do this is to make a television moment consistent with their narrative. This is not an investigation, this is propaganda for political theatre."

In April, an attorney for former New York City Police Commissioner Bernie Kerik said the committee's chair, Democratic Rep. Bennie Thompson, wouldn't accept Kerik's offer to testify publicly and had refused to make the transcript of his interview public.

They want an appearance of noncompliance," said attorney Timothy Parlatore at the time.

He told Just the News on Tuesday that the committee refused to allow Kerik to testify publicly and didn't allow him to have a copy of the transcript.

"The committee clearly prefers taped depositions because they can edit them and remove sections that don't match the fake narrative," he said.

Now that the televised public hearings have begun, the committee has been playing video clips from taped depositions given by former Trump campaign officials, former Trump White House advisers, and other members of his inner circle, including Ivanka Trump; Marc Short, chief of staff to former Vice President Mike Pence; former Trump aide Jason Miller; and former Attorney General Bill Barr.

Bill Stepien, former Trump campaign manager, was scheduled to appear in person before the committee on June 13 but cancelled due to his wife being in the hospital giving birth to their child.

Cassidy Hutchinson, an ex-Trump White House aide, alleged that Trump wanted to join the protesters at the U.S. Capitol on Jan. 6. Her appearance before the committee was a rare example of live testimony allowed during the public hearing.

Thompson's office did not respond to a request for comment on Bannon's recent offer to testify publicly and Kerik's previous offer.

Steve Bannon finally caved and agreed to be summoned to testify before the Jan6 committee.

But only if it is live and televised.

Crazy like a fox that guy.

It’s going to be a lot of very ugly, slow and heavy lifting, but the 1/6 Committe (Part Deaux) that will be empaneled in the House in January 2023 - the mirror image of this committee, needs to appoint a special subcommittee to microscopically investigate the Democrat’s 1/6 committee that we are enduring in this Congress.

I want every electronic communication of every member of the current committee, including what will by then be former House member Liz Cheney. Fully posted online. I think we need to reconstruct every editorial decision they made when producing the videos, and show what they left on the cutting room floor.

J6 is a good example to NOT go into the enemy camp and demonstrate. Strategically, it’s stupid as hell.

You demonstrate in your home state against the fascist federal government. That way, if the pig fascists want to come after you, they must enter your state and obey all state laws and mores. One step out the line and the fed pigs get arrested and thrown in jail.

Remember, the fat, weenie fed pigs don’t have the manpower to extinguish 10 brushfires in 10 different states. Put out one fire and 10 more will flare up.

Yes, it's true. Bannon announced it the other day.

I said the same thing as this article in the older thread.


If Bannon appeared virtually on Zoom, they could mute him or cut his feed (claim technical "glitch") if he strayed into forbidden territory.

If he wasn't live, it would essentially be a deposition where they would deceptively edit the testimony for prime time viewing (like Katie Couric did with the gun rights advocacy panel who had their own recordings).

Smart move. Unfortunately those that do get deposed/testify are at a disadvantage. The committee will not allow them to record their own testimony, (video or audio), and will not provide them with the transcript of the testimony. If, for some reason they are indicted for lying to the committee or some other charges related to their testimony the committee can, and have, refused to provide the transcript/video/audio other than the portion that they claim were part of the “crime”. The claim, and courts have agreed, that these documents/recordings are protected from subpoenas under sovereign immunity and attorney/client work products.

If it was me and I had a great attorney, (pro bono hopefully), I would agree to the deposition, under subpoena only, but demand that I be allowed to video tape it and also have a copy of the official transcript before I would testify. Upon the committee’s denial of my demand I would immediately file a suit in federal court for 1st, 4th and 5th amendment violations.

The reasoning is that things said during the testimony can be taken out of context, edited or manufactured leaving me open to criminal, (or civil), jeopardy and the evidence I need to defend myself is/may be withheld from me under the above stated means of denying me of the proof.
