To adapt what Stalin said of the Pope, how many divisions does the Supreme Court have? That seems to be the implicit slogan of Transportation Secretary Pete Buttigieg, who on Thursday ignored the High Court’s recent ruling with a proposed rule requiring states to reduce CO2 emissions on highways—that is, banish gas-powered vehicles.

In West Virginia v. EPA, the Court ruled that regulatory agencies can’t impose costly new regulations without a clear direction from Congress. The feds had interpreted an obscure corner of the Clean Air Act to impose costly climate rules on power plants.

Now the Federal Highway Administration (FHWA) wants to take this abuse of authority on the road. It cites an obscure provision in federal law that authorizes it to set national “performance” goals for the national highway system. The law defines these goals as safety, infrastructure condition, congestion reduction, system reliability, freight movement and economic vitality, environmental sustainability and reduced project delivery delays.

FHWA says this “environmental sustainability” language allows it to regulate CO2 emissions. Mr. Buttigieg needs a vocabulary lesson. Climate and environment are different even if the left conflates them.

While rising CO2 emissions over time affect the climate, these effects are global. Federal highway performance standards are intended to protect the local environment from traditional vehicle pollutants such as NOx or from highway construction. Brushing past this inconvenient distinction, FHWA declares that its “proposed GHG measure would help the United States confront the increasingly urgent climate crisis.”

The Biden Administration’s climate ends always justify its illegal regulatory means. FHWA claims that states will have flexibility in setting CO2 reduction targets but in the same breath declares they must align with the Administration’s goals to reduce emissions. In other words, states have flexibility as long as they do as the Administration tells them.

Well the difference is that they have a standing army of LEO brownshirts and judges and lawyers and DAs who will take your home, family, job. They will tear you apart with lawfare until even your dog can't find your scent. That is if they don't kill your dog first.

I remember the Trump administration continuing to pursue policies after they were shut down by the USSC.

Except that never happened. Trump respected the conclusions of the judicial branch, even when he didn’t agree with it. Too bad progressives refuse to do the same.

we knew libs would ignore the courts.

I am kind of amazed they stopped doing abortions in states that don’t allow it.

For a long time what I like and enjoy is being systematically eliminated. I am an anti-tech, Luddite and a Boomer. None of that is a crime.

I am losing dvds, cds, printed books, printed magazines and soon gas cars.

On a gigantically worse scale I lost my dear wife a few months ago and have found it more enormous a loss than I could have imagined after about 49 years of love together.

I am not cut out to live in this era, especially as America becomes totalitarian Communist-----day by day. With no freedom of thought, speech or assembly. I hate every day of this.

Just heard that in California there are daily miles long lines of owners of electric cars waiting for their turn to get 3 hour charges on their cars and trucks. As California is going to have to ration and limit electricity to the people again.

This is exactly what I expected. Every other agency completely ignores the SC ruling on the EPA and proceeds as though it doesn’t apply to them. And the EPA will interpret the ruling as only applying to one tiny portion of their agency and will continue to issue new rules that affect the entire country.

My sincere condolences to you. I also lost my wife earlier this year. It’s like a nightmare you can’t wake up from. I miss her terribly.

I just pulled that off a Reddit thread. I could not remember which president ignored the SC but thought it was Jackson. So I looked it up and it was Jackson.

The number of people who died being displaced is not entirely relevant to the discussion. What is important is the SC said the tribes could stay in the South and the president said no.

One of the Creek warriors who fought with Jackson at the Battle of Horseshoe Bend said if he had known what Jackson would do to his people he would have shot him there.

I lived near that battleground years ago and we would go there to visit and take a lunch. Sometimes I wonder how different things would have been if they stayed in Georgia and Alabama.

We will never know because the Democrat party always has to have its way.
