Henderson man threatened with HOA fines for anti-Biden sticker

LAS VEGAS, Nev. (FOX5) - A Henderson resident believes his freedom of speech is being violated over a bumper sticker on his truck.

A bumper sticker that reads “Let’s Go Brandon” is causing all the trouble for the man who is being told by his homeowner’s association that displaying the sticker on his truck is considered an offensive trader activity.

Chris lives in the Central Park Estates neighborhood located on the cross streets of Bermuda and Pebble. You can often see his red truck parked in his driveway usually with flags attached to it, but not anymore.

“They said I had to take it down because it was a sign or a billboard,” said Chris.

The HOA allows residents to have one political sign in the front yard during voting time. But since Chris left the flag on his truck after voting time was over, he was asked to take them down or else the HOA’s lawyer was going to take him to court.

“It makes me feel upset,’ said Chris. “I am a veteran. I did take an oath to this country. I believe freedom of speech should be everywhere.”

Chris resorted to implementing a bumper sticker that says “Let’s Go Brandon” on his truck, but was told this also isn’t allowed. The phrase has become an anti-Joe Biden phrase used by conservatives.

An HOA is a voluntary association of property owners who agree to abide by clear rules and regulations. When they are managed well, they can be a huge asset that helps protect the value of the homes in a subdivision.

HOAs are 'voluntary' only in an Orwellian sense of the word. It is pretty much getting so that if you want to purchase a newer home, you're going to be forced to 'volundarily' join their association.

They are a pestilence across the land, and tend to be run by evil and petty busybodies.

The HOA is paying the lawyer regardless of the outcome.

How is that? The lawyer doesn't send the letter. The HOA does.

I've never heard of such a thing. Maybe you live in the wrong area. Most of the newer homes in the area where I live aren't in HOAs.

As he told me about a recent case in a nearby HOA: "If you don't force a homeowner to take down his Alabama Crimson Tide flag today, you will not have the authority to force his neighbor to take down his Nazi flag tomorrow."

Exactly correct. If the rules aren't enforced equally, anyone who violates them can point to unequal enforcement and win in court.

I live in an HOA. Our rules are very basic and simple, and they're enforced. They have to be or they're meaningless. Everyone who moved in here knew the rules before they moved in. (We provide them to prospective buyers.) There's no shortage of buyers here, I am constantly contacted and asked if I'm looking to sell. (I'm not.)

I am going to disagree even though IANAL. Unfortunately the people moving into an HOA sign a contract that can bind some to give up some rights because they enter into a contract voluntarily. That is what gives HOAs the power...not the government.

Exactly, how can you have a conclave that suspends constitutional rights?

The Constitution protects us from the government, not from overreaching HOAs.

Our long cul-de-sac HOA doesn’t even allow trucks, even vans driven by homeowners for their work. They have to park down on the feeder street. Cuts down on people operating medium-scale businesses out of their townhome, and keeps their customers and employees from taking up the homeowners’ parking spaces.

The fact that the HOA is not literally a government is meaningless

It kinda is a form of local government. Ours doesn't get paid, but it levys fines, raises our dues to pay for services, and hires contractors to do maintenance. They are all Democrats, and rather than organize clean-up days or other civic activities, they just keep raising the dues and pay to get stuff done that owners should do, like pick up their own dog waste, or else get an HOA fine. But that would be work.

I am a lawyer, and I can tell you that if there is a HOA in a neighborhood and you don’t sign the paperwork, then you cannot buy the house in question. There is NO choice.

HOAs are quasi-governmental agencies, as the state/county/city (as the case may be) cede a certain amount of authority to them. Then (in most cases) the petty dictators who get on the HOA board generally make everyone else’s lives miserable, enabled by their friends, family and other assorted idiots in the neighborhood. It is generally very difficult (though not impossible) to get rid of these people once they are in place - kind of like Congressmen, and with similar results.

In the case of my HOA, several years ago they wanted to have a contractor resurface all of the roads in our subdivision, at a very high cost. I can guarantee that some friend or relative of one of the board members was the contractor, and that there was a kickback involved. However, since the neighborhood was then only about 12 years old, there was such a furor that a petition went around and another contractor was called in to evaluate the roads. The conclusion was that we could have the cracks filled in for about $10,000 and that would last for at least 10 years.

HOAs are just the lowest level of corrupt government, IMHO.

I don’t think we are arguing here. You said in your reply you can not buy the house if you don’t sign. Yep! If you are in an HOA though you did sign....a legally binding contract that possibly signs away your rights. That is my only point. If you claim this removes all new construction from your purchase choice I would also agree. I am an amateur radio operator. We tend to put up towers. hOAs do not like us. So my house CC&Rs are only 2 pages long and date back to 960. 8 made sure of that. I have been 8jnvolv3s peripherally in two separate legal fights on the antenna issue so had to get some education on the issues such as HOAs.
