The Department of Justice announced Tuesday evening the Biden administration will appeal Monday’s ruling by a federal judge in Florida that struck down mask mandates for air and Amtrak travel.
“The Department of Justice and the Centers for Disease Control and Prevention (CDC) disagree with the district court’s decision and will appeal, subject to CDC’s conclusion that the order remains necessary for public health. The Department continues to believe that the order requiring masking in the transportation corridor is a valid exercise of the authority Congress has given CDC to protect the public health. That is an important authority the Department will continue to work to preserve,” DOJ released in a statement. “On April 13, 2022, before the district court’s decision, CDC explained that the order would remain in effect while it assessed current public health conditions, and that the Transportation Security Administration would extend its directive implementing the order until May 3 to facilitate CDC’s assessment.”
“If CDC concludes that a mandatory order remains necessary for the public’s health after that assessment, the Department of Justice will appeal the district court’s decision,” the statement concludes.
Earlier today President Joe Biden was asked about the mandate and said the decision about whether to wear a mask while traveling is a personal choice. His new Wuhan coronavirus advisor pushed for the reinstatement of the mandate.
The CDC is a component of the Executive Branch. How could it be independent of the Biden administration? I'd argue we shouldn't want it to be an independent entity unanswerable to the public in any form.
Also, this announcement doesn't change anything from yesterday. Yesterday, we were told the DOJ would appeal if the CDC determined the mask mandate is necessary. Today, we're told the same exact thing. The big question is what will the CDC do?
CTA in Chicago still requires face diapers. Funny thing is SEPTA in Philly does not, but Philly has an indoor mask mandate.
WOW, all good points. It demonstrates the ineptitude of government. “trust us” really isn’t good enough.
Exactly. Look at this from the perspective of Chinese/Russian/Iranian handlers.
Is a certain decision more or less likely to destabilize/hurt the United States of America?
If it does, go with it.
That’s like here in Utah, with the Frontrunner train! They had a mask ruling, but I saw several people without masks, and none of the train hosts stopped to tell them to put one on! They have extra ones, at the door with bottles of hand sanitizer. But people were riding without masks on, and no one was scolding them for leaving them off; and that was even before the judge made that ruling!
You are so correct because in the Land of the Free and Home of the Brave the people who vote will be so grateful to the Nanny State for deciding for them whether or not they must wear Masks on their faces with this big centralized bureaucracy making this decision for them in a one-size-fits-all manner instead of considering individual medical/health circumstances because the Central Democratic Control (CDC) knows best and we all must be obedient sheep.
Naw, if the Valley Metro security saw us with a mask off down they would tell us to pull it up. They weren’t on every ride though. Once in awhile even a bus driver would be, I guess looking in the rear view mirror or camera and saying to pull your mask up like we were little kids on the school bus misbehaving. How sad and pathetic. I’m guessing the majority of bus drivers didn’t want to get in trouble since there were cameras. Plus, I’m sure there would be Karens complaining if the drivers let us be free.
