Motion to extend Emergencies Act approved in House of Commons

OTTAWA — The House of Commons on Monday night approved the extraordinary and temporary measures in the Emergencies Act, heeding Prime Minister Justin Trudeau’s warning that the “state of emergency is not over,” even though police ended a three-week occupation in Ottawa and reopened border points to the U.S.

The motion to confirm the declaration of emergency passed 185-151, with the New Democrats voting in favour alongside the minority Liberal government.

The Conservatives and the Bloc Québécois opposed it.

The vote to approve the measures will keep them in place until mid-March at the latest and the Senate must also vote on the government’s request.

At any point, the Senate, House or government could pull support and the extraordinary powers stemming from the emergencies law would be torn up.

Speaking to reporters on Monday before the vote, Trudeau made it clear that there are still protesters and truckers awaiting an opportunity to come back to Ottawa, some of which are in the towns of Arnprior and Embrun, respectively 70 and 45 kilometres away from Ottawa.

If the senate opts not to vote to approve, are the emergency powers null? Or do they have to vote in the negative for that to happen?

If the Senate does not vote, the emergency powers are nullified.

Section VI part 58 (1)..(7)

The motion must be tabled in both House’s by seven days and they must vote. The Senate cannot ignore either the call to quorum nor the obligation to debate without interruption until a call by the speaker to vote. Only a negative vote on the motion revokes the motion. Doing nothing allows the standing motion from the house of commons to stand until the Senate answers their summons or 30 days. The Senate has one day after they answer the summons to table a motion ,and begin continuous debate till the speaker calls a vote. Canada writes clear laws not like the USA where they are poorly written to allow legal tomfoolery by both parties to suit their grifter ways.

Canada’s Parliament may as well disband at this point. They have voted to give Trudeau absolute power and he will keep it as long as he likes. Oh, there are words written on paper saying they get to decide this and that but any move made which seeks to strip him of some power will end up with them being arrested for crimes against the government. There is nothing to stop him.

I don’t believe any of that actually matters to Trudeau at this point. He will not allow his power to be removed. It’s for the security of the nation, dontcha know? Votes against him are a direct threat to the safety of the Canadian people. And any who do so will find themselves in a very precarious predicament.

The Canadian senate will have to vote they have been summoned. 42 are independent senators but a good number of them are Tboys appointments or his dad’s while their jobs are safe basically for life their party mates in the lower house will ve wiped out in the coming election if they loose the liberal bloc. It’s a given that the Senate rubber stamps the motion. He already threatened to disband the government which in parliamentary systems means an immediate debate and vote for confidence,the vote in the lower house was seen by most as a call for a vote for confidence but the lower speaker when directly pressed to make it an official vote for confidence simply ignored the request and out up the vote on the EA. Parliamentary systems are so much different than the US system people here have a hard time understanding the nuances of it.

Looks like the Canadian Senate is starting debate today on the EA as required by their charter. They could go all day and night but the vote must happen once the debate is started it is the only way to end the debate. The question is will enough of the 42 say aye, the 16 CPC are nays for sure.

I think the 17th amendment was a mistake. If state legislators appointed Senators they’d have to be more loyal to their states. As of now, they’re more loyal to their parties and big money interests.
