Jury begins deliberations in Ahmaud Arbery murder case

Jurors in the Ahmaud Arbery slay case started deliberating Tuesday over the fate of the three white men accused of killing the black unarmed jogger in Georgia last year.

Gregory McMichael, 65, his son Travis McMichael, 35, and their neighbor William “Roddie” Bryan, 52, are charged with murder, aggravated assault and other crimes in the shooting death of Arbery, 25, who they suspected was fleeing a burglary as he ran through their neighborhood near Brunswick.

Superior Court Judge Timothy Walmsley told the jurors Tuesday, “It is your duty to consider the facts objectively without favor, affection, or sympathy to anyone.”

Walmsley directed them to retire to the jury room, where they began officially deliberating the case at 11:53 a.m..

It’s a tricky case; they are not being charged with 1st degree murder, but felony murder. The point of contention is whether, by aiming their firearms at Arbery while trying to make a “citizen’s arrest”, this constituted aggravated assault by the defendants that Arbery was justified in responding to with force.

If the jury thinks that is the case, then Arbery died while the defendants were committing a felony, and they are then also guilty of felony murder. If the jury thinks that pointing a gun in that context is not unlawful, then they should be found innocent.

I suspect that they’ll be found guilty of something. Arbery was almost certainly poking around the under-construction house looking for something to steal, BUT it wasn’t the defendants’ house, so this isn’t really a self-defense or home-is-my-castle type case. Everything hinges on the extent to which the jurors think that the defendants’ conduct was reasonable when engaging in a citizen arrest under these circumstances. I’m guessing that there’s going to be a lot of discomfort with the idea that folks engaging in citizen arrests of suspect burglars (of someone else’s house) have broad authority with respect to use of force.

After they stopped him, Arbery attacked one of them and tried to take his gun, which is where the self defense claim comes in. Of course, they were pointing their guns at Arbery, which may have given Arbery the right to defend himself from them. So there are competing claims there, and it probably all comes down to whether they had justification for the “citizen’s arrest”.

I’m not blaming him, I’m answering the other poster’s question of how could they even claim self defense.

A different approach I would have done is run into the woods. They had a truck and are white guys. I’m guessing the young black male is faster...

I didn’t watch this trial, but noticed on the news how they immediately made Arbery to be a martyr. The narrative became that he was just out for a run, as he was a regular runner. My guess is that was a lie, but other than that, it seemed a bit sketchy.

This was the "innocent jogger" carrying a hammer case from February 2020.

You might remember the case from the below picture. A guy was caught on a web cam walking through a house under construction and rummaging through toolboxes.

Two guys chased him down in a pickup truck, one with a shotgun standing in the bed of the truck, while a third person gave chase in a separate vehicle and caught some of the action on cell phone video.

The guys in the truck confronted the guy they were chasing (Ahmaud Arbery) and while fighting over the shotgun, it discharged, killing Arbery.

At least that's my recollection of the gist of the matter.

Like the Rittenhouse case, those who have followed the trial and listened to the evidence understand it’s another political prosecution to placate Antifa-BLM, and the defendants are not guilty and never should have been charged.

What is disgusting is that the Leftist prosecutor and the judge have wrongly presented the law regarding citizen’s arrest in the closing rebuttal and jury instructions, respectively. They’ve placed their elbows on the scales of justice, to which the defense attorneys have objected and which will form a basis for a mistrial if any of them are (wrongly) convicted.

This isn't the Rittenhouse case. These guys chased the man down, threatened to blow his head off if he didn't stop, accosted him with drawn firearms, and when he defended himself they shot him. That should add up to a guilty verdict but we'll see.

I saw the video of the event. I think they ‘defendants’ were wrong. They should have called the police and backed off. I suspect they will be found guilty.

Except he wasn't carrying a hammer. No evidence of a hammer was presented in court, either by the prosecution or the defense.

Except the video doesn't show him rummaging through toolboxes. Walking through the construction site, yes. But that's it.

That’s the problem with the trial — the prosecutor and the judge have misinterpreted the citizen’s arrest statute, and the jury has been wrongly instructed. There is immediate knowledge “or” prior suspicion, but the state and the court have told the jury it’s both (”and”).

The defense lawyers have objected, and it likely will form the basis for an appeal and mistrial if any are convicted.

Very heated and discussed topic.

Then Covid happened. And that was that.
