LIVE: Kyle Rittenhouse Trial - Day 8 (with Day 1 being Jury Selection)

Today we have to wonder what will be the more likely cause of the next riot in Kenosha, Wisconsin. Will it be an acquittal of the defendant either by the jury or a directed verdict of Not Guilty? And if the latter happens will they riot because the judge is apparently a Lee Greenwood, even to the extent of have "God Bless the USA" as a ringtone on his phone.

The judge suggests that the trial should be ready to wrap up by Tuesday.

Progressives Demand ‘Mistrial’ Over Rittenhouse Judge’s ‘God Bless The U.S.A.’ Ringtone

I expect soon that legislation will be introduced that no one may act in the capacity of a judge in a BLM/ANTIFA-related case unless they can prove that they share their vision of a defunct America. Never again will we see judges with pro-American values.

I don’t remember exactly what I heard this this but I believe it was possibly Rush Limbaugh mentioned some sort of campaign back in the 70s. A campaign where a local government tried to place blame of car thefts on owners leaving the keys in the ignition. Something like do not leave keys in the ignition or you might cause someone to become a thief.

I guess after the computer/video guy, Black, they will be done with testimony and next will be closing arguments. I wonder if they will just call it a day and have closing arguments tomorrow. I don’t think they have yet agreed on the jury instructions. They might work on that this afternoon.

I’m praying that there is at least a couple jurors who can put themselves in Rittenhouse’s place and see he had no choice once he was attacked. He never initiated an attack upon anyone but simply responded when other attacked him.

He only had a brief segment less than five minutes long to deal with, and only about 5 or 6 seconds of meaningful sequences - what can you expect from one with such limited data?

What specifically didn’t you like about his evidence?

Dr. Black may have been brought into the case on very short notice. If so, one would not expect his presentation to be as polished. The defense may have a limited budget and Black worked within those constraints.

I was going to comment on him a little earlier. It seems like every time he was on camera he was eating or drinking something.

I believe that an instance such as you describe would be called a “crime of opportunity” and I suppose that irresponsibility on the part of the car’s owner does contribute to that crime.

If I remember correctly, the phrase was, “Lock your car. Take your keys. Don’t help a good kid go bad.”

From Branca:

Looking at maybe instructions tomorrow morning, then closing through mid-afternoon Friday.

Parties would rather they get instructed, closing on Monday, deliberate through Tuesday.

Judge reluctant, taking under advisement.

Parties would like to do closing on Monday.

Judge wants to start a new jury trial on Monday. Jury has been here a long time.

Binger: Not sure we can give them jury instructions today.

The judge doesn’t want to declare a mistrial, even though he could.

The prosecutor wants a mistrial, and the judge isn’t going to give it to him. Judge can always grant the pending motion for a mistrial if the jury convicts.

Judge knows the jury is going to find Rittenhouse not guilty, so he is not going to bail out the prosecution. The judge is not going to allow the prosecutor to blame the judge for a mistrial or directed verdict.
The Judge can still do those things of the jury convicts Rittenhouse.

Judge has been on the bench for 40 years, so he knows the games dishonest prosecutors play.

Prosecution has a short case after defense, which may include some cross exam. That likely happens this afternoon. Judge wants to start on instructions and verdicts today.

Some dbate on whehter to charge jury tomoorw, likely run into saturday, or charge them on Monday. Judge has tentatively agreed to Monday.

Jurors would rather they get the case and start deliberations tomorrow afternoon. Just how long does it take to vote not guilty on all charges? An hour; two at the most?

I sure would. But juror convenience and preference is not a consideration. Only what is convenient for the judge and lawyers.

You can say whatever you want when not under oath.

Binger knows that the jurors are sick of this and if given the chance to be done and enjoy their weekend they are going with not guilty on Friday.

As a very naive watcher, how can a judge sense what the jurors are thinking? I’m sure this is true for a veteran judge, but I’m curious what he looks for or what he sees to believe a non guilty verdict. This is quite interesting. Thanks for your answer.

The most obvious indicator is body language. If, when the defense is presenting their case the jurors are giving their rapt attention, as opposed to the state’s case where they may well be seen looking inattentive or outright bored.

I read that half the original juror’s pool were gun owners but don’t know about the final jury. Probably depends on if they live in the city or are more rural. My biggest worry is they’ll be like the Chauvin jurors, worried about retribution from the Left. They already know that video/pics have been taken of them. MSM and biden have already set up the narrative that Kyle’s a white supremacist.

Kyle’s best hope is that the jurors are glad that riot night 3 didn’t see as many businesses burned because of people like Kyle being an armed presence and guarding businesses.
