Certifications based on fraud are invalid. Fraud vitiates everything. Basic legal principle.
The problem isn't about a legal path.
The problem is that the courts, the electors and the state legislatures don't have the courage.
Really??? This is unprecedented in every way. It’s not clear that the founding fathers intended us to just go home after the game was stolen and hope they play fair next time. I seem to recall something about watering the tree of liberty with the blood of tyrants.
Per our last conversation, the democrats are going for gold and are attempting to insure that a conservative never wins again. We either fight here and prove any wrongdoing now, or forever hold our peace.
Constitutionality is up for debate, but if we catch those bastards with their hands in the Cookie jar, most Americans would help figure away to get the criminals out of office.
Call you tomorrow.
Let’s find out what we are dealing with first.
Get angry my friend that’s the game I won’t get angry can’t take that but I will vote in 2022. I don’t need to have my animus aroused to vote.
We’ll see how it turns out in 2022 when we all vote.
No court has jurisdiction over the matter of a seated federal officer.
No court.
The problem is that you are looking down the wrong path.
There are solutions, but recalling electors is nothing more than symbolic (which has some meaning), and has no legal significance after their votes were accepted.
The Constitutional rules were NOT broken.
NO state disputed it’s electoral slate, no Congressional action did either.
A candidate committed fraud. The states chose their electoral slates based on the idea that there wasn't fraud.
Exactly. The State can declare the elections fraudulent, vacate the current office holders, and run a new secure election.
If the certification is based on fraud them it is invalid.
“She is absolutely NOT a McCain republican. She is trying to keep the waters calm.”
What are you talking about?
Personally, Repubs took the Senate and probably the house also after an audit of every state. They could pass laws that would give Trump 3 terms and then dissolve the law back to 2 terms.
Whatever happens it better be satisfactory to Trump and his voters. This is why we have the 2nd Amendment in the first place.
“If the certification is based on fraud them it is invalid.”
The Constitution gives state legislatures the sole authority in determining how electors are selected. If the state legislatures take no action, constitutionally, there’s nothing anyone else can do about it.
Then, subtract 11 EV's from the "winner's" total, and we proceed to do the same to PA, GA, WI, MI...
The fraud must be exposed.
However, if all those states EVs are subtracted, Xiden still has the necessary total to "win."
It's only if those votes are switched would Trump then have the numbers.
Not happening.
Expose the fraud and make damn sure those contested states (and others) clean up their elections. That, should be the gameplan for these audits.
She is correct. They do not have the authority to recall the electors.
They can decertify the results, make arrests, file charges, etc.
And the Legislature can then “select the President according to the will of the people.”
These are truly historic times and we must ask ourselves what our grandchildren will think when they read this history. They will ask if such a great wrong was committed, why nothing was done to correct it.
What will we tell them?
Brilliant point
Yes. According to state law the Arizona Secretary of State certifies election results and not the legislature. If the legislature doesn't certify the result then how could they uncertify them?
Will Cyber Ninjas present their findings to a court of law and provide their evidence? If not then why did they do it all to begin with?
Constitutionally it can't.
