The Biden Administration took control of a Texas rancher’s border land on Wednesday. The action followed a victory by the U.S. Attorney’s Office for the Southern District of Texas against the family which has owned the land since 1760.

My family left Mexico to come and live and ranch in Texas in the 1780’s-they were Hispanic working class herders/ranchers with no love for the noble ruling class that had an iron fist in Mexico-several family members still own and make a living from those small ranches-I grew up on one in W Texas-fortunately, none of that land is closer than 30 miles from the border-my family is republican and conservative, but I doubt any of them would give up to eminent domain-for ANY reason-without a fight to the death, after a couple of centuries.
Eminent domain in the past was a way for developers to collude with government to get rural agricultural acreage to cram commercial and residential buildings into-fortunately, many rural counties have put a stop to that in the last 20 years-water and other resources are needed for growing food and grazing livestock-not more crowded, noisy and dirty city expansions-otherwise, eventually no one will have anything to eat...

Trust me-no ranch within 15 or so miles of that border is “safe” even when I was a kid people who ranched close to the border carried loaded guns while riding their fence lines, putting out feed in pastures, etc-the cartels were active then and you could end up dead if you ran into them and were not armed-it is worse now, I’m told by family members in W Texas...
The cartels must have sent in the point of entry they want.

Not stolen. The rancher will be paid at a reasonable price for the acreage.
The original source says the size of the ranch is 77 acres. The amount of land to be condemned is a 6.584 acre strip that will bisect the property. The owner claims that this will devalue the property because renters will not have access to water for cattle. I think in similar cases, the Trump wall often used controlled access gates to allow owner access to the river bank.
Whatever the specifics are, federal judges will decide the facts and $$$ now.
Property rights via Spanish land grants were recognized by the US in the treaty that settled the Mexican American war. In current times, actual land ownership is often a legally tangled mess. There could easily be 10 or 50 heirs with a fractional ownership interest. All it takes is one heir to prevent an amiable agreement and toss resolution to the courts.

The vast majority of ranchers on the border (Anglo and Mexican) want that wall. It protects them. Those that do not want to sell a small portion of their adjacent land on the river are probably involved with the cartels. Of this family, I do not know.

A bit of an oversight, then, that Biden didn't get the DOJ to halt the case. Unless the new plan is to build a welcome center there, instead of a wall.

If it cuts of his access to the water it will be a problem. I do not understand how these gates work that give ranchers access to water.

In fact one wonders WHY you need fee simple ownership at all, just take a perpetual easement, high line companies and pipelines do so every day...............
