Ex-Trump lawyer Powell asks judge to toss voting machine company's $1.3 billion lawsuit

Sidney Powell, a lawyer who advised President Donald Trump’s campaign, asked a judge on Monday to throw out a $1.3 billion lawsuit accusing her of spreading false conspiracy theories about the November presidential election.

Powell said in a filing in federal court in Washington that there was a “no basis” for the lawsuit brought by Dominion Voting Systems Inc in January.

Powell, represented by three lawyers, argued that claims she made about Denver-based Dominion were protected by the right to free speech under the First Amendment of the U.S. Constitution.

She said her claims about Dominion were meant to be hyperbolic, and that “reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process.”

No. Republican office holders refusing to do their d@mn jobs and demand answers for a fraudulent election is why we have 2 Democrat Senators now.

If the system is rigged, you are always going to get the rigged outcome. The solution is to dismantle the rigging process, not worry about what some attorney said.

You think Lin Wood did this all by himself? No, it was pretty much Republicans disgusted with the Rino efforts to ignore the election fraud.

You have it correct, Paladin2. This was an attack on many fronts. Dominion was just one. Mail in ballots were another.

And you know what? The Leftist knew that, no matter how much proof came out, inertia was going to drag Biden across the finish line, and the result will never, ever be reversed.

People who think pursuing the mail in ballots exclusively would have given a different final result of Biden in the White House are deceiving themselves, IMO.

What always worried me about her is that she was an attorney on the Enron/Andersen side of the Enron scandal—which was as Establishment as you could get. Then when she wrote a book about it, she cast Judge Sullivan as a hero.

Similarly, Lin Wood has made a career being the guy who essentially “buys off” (gets a settlement for) whatever Leftist operation patsy needs some buying off: Richard Jewell, Nicholas Sandmann, Kyle Rittenhouse.

Finally, who’s someone else who came in defending them and Trump? None other than the longtime protege of Bill Gates’s “best friend” Warren Buffet. That is, Patrick Byrne, who also admits having done work for the FBI and faced legal problems of his own.

Something is off with this whole team IMO. Unfortunately. (They’re all quite bright as well, which makes innocent bungling less and less likely an explanation.)

The Enron case was eventually thrown out because Andrew Weissman invented new law to charge them with. Yes the same piece of sh*t that Investigated Trump for Russia collusion.

The case was totally tossed out and the men freed from jail on appeal. So those several thousand Enron workers lost their job for nothing.

More a case of Enron being the Bushes’ bag men and so their case had to get thrown out—with Powell there helping it to happen.

Enron failed and the employees lost their jobs for that failure of their management. Powell represented the Arthur Anderson employees and I will agree that the governmental rape of that firm’s employees was terrible and should not have happened.

Then this lawsuit presents her with the chance to prove her innocence and Dominion’s guilt at the same time. She should welcome it instead of trying to get the case dismissed instead of claiming she wasn’t stating ‘facts’.

Umm...Dominion machines in Antrim County DID switch 6,000 votes to Chyna Joe.

I'm sure it wasn't the only instance, by far.

I don't see even see one complete Powell sentence quoted. Most of it is Reuters, putting their words around Powell's words.

I'm sure that this is not a fair or accurate summation of the argument's that Powell's lawyers made in their motion to dismiss for failure to state a claim against her.

One of the arguments is that they are public figures, but they also said it just wasn't true. Here's the actual defense statement:

The bottom of page 41 of the pdf (page 27 of the document)(emphasis mine):

"Determining whether a statement is protected involves a two-step inquiry: Is the statement one which can be proved true or false? And would reasonable people conclude that the statement is one of fact, in light of its phrasing, context and the circumstances surrounding its publication. Analyzed under these factors, and even assuming, arguendo, that each of the statements alleged in the Complaint could be proved true or false, no reasonable person would conclude that the statements were truly statements of fact."

Frankly, I'm furious.

This means she expected to prove this in court but also expected they would not be accepted as fact until the process was complete. Which is exactly how the law works every single time.

3rd, lawyers go with the path of least resistance. It is easier to dismiss the suit than to prove the fraud.

This particular response should have been expected. It’s not evidence of a grift. Tucker Carlson and Maddow used this defense and won.

I wasn't too keen on some of the things said by Lin or Sidney after the election in Nov or before the run-off in Lin's case. That said, I really don't have any knowledge of what was going on behind the scenes with them and what their intentions might have been.

I did however listen carefully to the phone conversation between Lin, the Dean of the Mercer Law School, and various students. He sounded sane for someone accused of having gone crazy.

If you look at the northern lower tier of Michigan counties [all red] going from east to west [this includes Antrim], the "turnout" for joek and the ho was astonishing.

We're talking 125-135% over 2016 for Cankles.

There was shady stuff going on.
