Supreme Court Hands Trump Monday Losses On Tax Returns, PA Election Challenge

The Supreme Court on Monday denied former President Trump's request to halt the release of tax and other financial records to Manhattan District Attorney Cyrus Vance.

In their ruling, the justices refused to block a subpoena to Trump's accounting firm, Mazars USA, while he continues to push for a Supreme Court appeal, according to Bloomberg.

The high court had deferred acting in the case for more than three months, waiting until Trump again became a private citizen to take a step that could boost Manhattan District Attorney Cyrus Vance’s probe. Vance’s investigators have already gotten hold of some of the tax records from other sources, according to people familiar with the matter. The investigation looms as one of the biggest legal threats to Trump, though its exact parameters are unclear. - Bloomberg

In August, Manhattan prosecutors indicated in court filings that they were investigating tax fraud, insurance fraud and falsification of business records. DA Cyrus Vance agreed to hold off on enforcing the subpoena while Trump's Oct. 13 motion to stay was under consideration by the Supreme Court.

Trump's challenge to the subpoena - which claims it's too broad and issued in bad faith - was rejected by two lower courts prior to Monday's rejection at the Supreme Court. Mazars, meanwhile, isn't contesting the subpoena and says it will comply with all legal obligations.

While Trump's tax records will technically be shrouded in grand jury secrecy, Trump's lawyers told the Supreme Court that he will suffer "irreparable harm" if the materials are turned over, "Even if the disclosure of his papers is limited to prosecutors and grand jurors, the status quo can never be restored once confidentiality is destroyed."

Vance's office countered, saying that Trump "has had multiple opportunities for review of his constitutional and state law claims, and at this juncture he provides no grounds for further delay," adding "His request for extraordinary relief should be denied, and the grand jury permitted to do its work."

The court on Monday also denied Trump's challenge to the Pennsylvania 2020 election results as moot. Dissenting from the decision were Justices Alito, Gorsuch and Thomas.

The court also formally rejected separate appeals by Trump and his allies seeking to overturn President Biden's victory.

Gosh, didn’t see that coming.

I was not all that surprised, disappointed but not surprised at all. We now have a 5-2 court sometimes 5-3 so we are much worse off than we were before Trump. Remember we need Mitch for the Judges, well we got them.

Alito, Gorsuch, and Thomas were in favor of looking at the cases. Kavanugh and Barret caved.

Kavanaugh DISSENTED, along with Alito, Gorsuch and Thomas.

I suspect Barrett did not participate, resulting in an evenly split vote.

“Heaven forfend that you concede that President Trump made a botch of most of his hiring, particularly his judges.”

You are a troll and a stupid one at that. Trump was and is NOT a politician and had absolutely no way to know who would be a “reliable” Conservative choice for the Judiciary. Like all before him he depended on good advice from those who were supposed to be carrying out his agenda.

In corporate America where Trump spent his life he would have never allowed this to go unpunished and would have cleaned house in the 1st 3 months. His big mistake was he trusted in those he thought loved America as he does.

Kavenaugh already showed his colors in the past. Now we know for sure that ACB is bad news too. I already guessed it based on the Texas vs PA case. I hate to say. But Trump really screwed us here. The country will never recover from this.

Kavanaugh is a Bushie, and Barrett was pressured into not getting involved in anything Trump related during her hearing. At least Gorsuch voted to protect the Constitution in the PA case.

The Court decided to be Pontius Pilate and just wash their hands over Constitutional issues that are controversial, leaving local Dems to ignore the Constitution however they feel like.

Exactly right. I believe when the feds make their move against the Second Amendment, the Tenth Amendment will be exercised in red states.

Not only the Second but every right of the states to run their own according to that particular states needs.....like Texas and their energy needs, border protection to name a couple..........in other words tell the Feds to ESAD!!!

Do you have the link for that? We are talking about today’s decision. From what I read if they had four justices then it would have moved forward but they didn’t. And why wasn’t Barrett part of the decision?

There was never any evidence these were “Trump judges.” They were mainline GOP credentialed picks. They won’t change their behavior until the GOP pays for it at the ballot box.

Trump needs to forget running in 2024 and tell us the truth about the bipartisan coup now. It will make him look weak so it is understandable why he avoids the topic.

‘It takes the votes of four justices to accept a case for review. Although changing election rules because of the pandemic has been a theme of Republican challenges in the wake of Trump’s defeat, the rest of the conservative majority was silent.

Neither Chief Justice John G. Roberts Jr. nor two of the three justices nominated by Trump signed on to dissents from Thomas and Alito. Besides Gorsuch, Trump chose Justices Brett M. Kavanaugh and Amy Coney Barrett’.
