Alito, Gorsuch, and Thomas were in favor of looking at the cases. Kavanugh and Barret caved.

Kavanaugh DISSENTED, along with Alito, Gorsuch and Thomas.

I suspect Barrett did not participate, resulting in an evenly split vote.

Do you have the link for that? We are talking about today’s decision. From what I read if they had four justices then it would have moved forward but they didn’t. And why wasn’t Barrett part of the decision?

The text below from the Wash Post says otherwise. Kavanaugh is just one more of Trump’s busts.

‘It takes the votes of four justices to accept a case for review. Although changing election rules because of the pandemic has been a theme of Republican challenges in the wake of Trump’s defeat, the rest of the conservative majority was silent.

Neither Chief Justice John G. Roberts Jr. nor two of the three justices nominated by Trump signed on to dissents from Thomas and Alito. Besides Gorsuch, Trump chose Justices Brett M. Kavanaugh and Amy Coney Barrett’.
