State Senate On Target To Vote Monday On Contempt Action Against Maricopa County Board (Can Make Arrests)

The full State Senate could vote as early as next Monday on a resolution to hold the Maricopa County Board of Supervisors in contempt for failing to comply with two legislative subpoenas issued last month related to the 2020 General Election, the chairman of the Arizona Senate Judiciary Committee announced Tuesday.

“The resolution is being introduced and is expected to have its First Read on Wednesday,” Sen. Warren Petersen told Arizona Daily Independent. “It could be on the Senate Floor as soon as Monday.”

The resolution can pass with only a simple majority of the votes, which is 16 of the 30 senators. Petersen said it would then be up to Senate President Karen Fann to exercise her contempt authority to call for the arrest one or more of the five Maricopa County supervisors.

Petersen’s announcement came after the Maricopa County BOS held an emergency morning meeting to address what has been characterized as a final demand by Fann and Petersen for county officials to provide a timeline by Noon on Tuesday of when the subpoenas would be complied with.

The BOS convened around 11 a.m. for less than 90 seconds before going into a non-public executive session. The supervisors did not come back into open session, but BOS Chairman Jack Sellers later said the county continues to reject the Senate subpoenas.

Among the items included in the subpoenas are the county’s voting system equipment, voter registration records, election system software, and even the 2.1 million ballots cast in the Nov. 3 election. The intent of the audit, Petersen said, is to look at all facets of how the county managed the election, from before ballots were mailed out through to the tabulation.

“It is truly unfortunate that today Maricopa County has refused to comply with the subpoena and allow the Senate to conduct a forensic audit of the election,” Petersen said. “There is no legal consequence if they allow us access to the machines and ballots. However, there are serious legal consequences for failing to comply with the subpoena.”

The power of the Arizona Legislature to issue and enforce subpoenas was the subject of a December 2020 legal briefing by the Arizona Attorney General’s Office. In the brief, Deputy Solicitor General Michael Catlett argued the legislature has “broad authority to issue and enforce legislative subpoena,” including the “authority to investigate” how Maricopa County administered the recent election.

“Separation of powers prevents one branch of government from usurping powers of another coordinate branch of government or delegating power to another coordinate branch,” Catlett noted in the brief. “Separation of powers does not, however, insulate a subordinate division of government (like the County), which derives its powers from the Legislature, from oversight in the administration of something as fundamental to American democracy as elections.”

Under Arizona Revised Statute 41-1155, anyone issued a legislative subpoena who then refuses “to attend, or to be examined as a witness, either before the house or a committee, or before any person authorized by the house or by a committee to take testimony in legislative proceedings” may be punished with contempt “and by imprisonment.”

And under ARS §41-1154, a person who “knowingly fails or refuses without lawful excuse to attend pursuant to such subpoena, or being present knowingly refuses to be sworn or to answer any material or proper question, or to produce, upon reasonable notice, any material and relevant books, papers or documents in his possession or under his control, is guilty of a class 2 misdemeanor.”

The Maricopa County BOS is not scheduled to meet again until Feb. 8. The supervisors and other county officials are receiving legal advice on the subpoena issue from in-house counsel at the Maricopa County Attorney’s Office as well as private lawyers paid for by taxpayers.

BRIEF BACKGROUND

Maricopa County Board of Supervisors (MCBOS)has been stonewalling the legislature since early December 2020 coming up with lame excuse after lame excuse to evade handing over ballots and election materials. As a last measure before the state legislature adjourned its session earlier this year, the MCBOS sued the AZ legislature to stop enforcement of the subpoena claiming voter privacy concerns; very lame.

The legislature had to adjourn making way for a new legislative session. When they opened the new session, they renewed the previous session's subpoena to the MCBOS and a Court date was set for January 20, 2021. On that day in court, the MCBOS caved and agreed they were no more than a political subdivision of the state legislature and were therefore subordinate to the legislature, and they agreed in court to comply with the legislative subpoena to turn over ballots and election materials. Days later they were back to playing games.

The game they most recently started was to call for THEM, the MCBOS, to conduct their own forensic audit and they were busted by choosing auditors that had worked and were still tied to Dominion. I think this is called a case of SHMENDRIK CHUTZPAH.

They are playing games because Jovan Hutton Pulitzer's team can nail the election steal without messing around with the Dominion machines and so prove the MCBOS complicit in election crime. Their behavior reveals they are in on it.

So either way the MCBOS could be looking at criminal charges.

If I was on the MCBOS or a staff member, I'd be packing up the U-Haul and heading out as fast as possible towards Baja.

It is unknown if arrests will be made unless the liars and crooks on the MCBOS fail to turn over the keys to the Court. If that happens, then yes, someone will be getting jail time.

Actually, it probably will happen that MCBOS refuses to turn over the keys, why? Because a full forensic audit will expose the election crime and the board members can be charged as a result. This is why they are behaving the way they are, playing hide-and-seek with the ballots and materials.

Either way, the Board is looking at jail time unless some thug with a law degree like Mark Elias can swoop in with Clinton mafia members and get to the Judge or members of the state senate. (I hate thinking this way but it's become the norm backed by historical events)

If a Contempt Resolution passes, it will be taken back to Court and given to the Judge who will then order the Maricopa board to turn over the keys.

There are 5 members of the Maricopa County Board of Supervisors, 4 of which are Republicans. Very similar to GA where it is Republicans that are implicit in the fraud.

Judges don’t like willful disobedience especially after Maricopa agree in court on January 20 to comply and then chose to play games after.

I would posit that the democrat party has been using Maricopa to, at the very least, tip the scales of elections to the democrats.

This seems to be a pattern. Get control of one or two of the most populous districts in a state and vote mine to tip the scales.

Arizona- Maricopa County

Michigan- Detroit

Georgia- Fulton County

Wisconsin- Milwaukee

Nevada- Las Vegas

Florida- oh wait, Miami Dade and Broward got cleaned out by DeSantis. The result? Suddenly the margins failed to get tipped. Coincidence. I think not.

This battle in Arizona should be fought in every state where the GOP holds the legislatures.

They have had more than enough time to properly lose the evidence.

At least AZ Senate seems to be trying, unlike WI, MI, GA. But really, at this point, put the hammer down. Up the stakes by sending a formal request for all of these guys and their families to investigated by the AG including but not limited to all financial records and dealings.

Former prosecutor, now professor of law, all round good guy David K. Clements says that given federal and state laws requiring preservation and protection of the paper ballots, any spoiliation of the ballots will move the Court to rule valid claims made by the moving party, in this case the state legislature.

Maricopa County is screwed no matter what happens.

Serious persons involved in this AZ fight say if AZ breaks through the lies and coverups proving their state’s election was stolen, that 16 other states will pounce and follow suit.

This is a big deal.

District 1 Supervisor Jack Sellers (R), District 3 Supervisor Bill Gates (R), District 4 Supervisor Clint Hickman (R), and District 5 Supervisor Steve Gallardo (D) were named in recall petitions after the board voted 4-1 to not respond to subpoenas that were issued by Republican members of the Arizona State Legislature seeking an audit of Maricopa County’s election software following the 2020 presidential general election, according to ABC 15.

I know a little about contempt charges as I once was found in contempt in a divorce proceeding. I got 1 week but they let people out after only 1/3 of a sentence so I only spent about 2 1/2 days in jail. I will be surprised if these 4 “Supervisors” get anything.

This is something I've never understood. Why the hell should taxpayers be on the hook for private lawyers? It is quite apparent that when the government does this, that they are admitting outright that their own government lawyers are incompetent. The question that should be asked in that case, is why the hell are taxpayers paying the salaries of the incompetent lawyers in the first place?

So why doesn’t the legislature just act? Call Jovan Pulitzer and send the State Police to seize the machinery and arrest the BOS? There is clear evidence of election tampering.
