There were several here who pinned the impeachment as a bill of attainder early on in this process. Once again, FR leads the way.

Protesting the failure of government to enforce election laws is far from being “insurrection”

I just noticed that GOOGLE is changing the definition of “insurrection” to mean “an uprising against the government” when previously it meant “an attempt to overthrow a government”

There is only one article of impeachment and all the associated allegations purport to be in support of "Article I: Incitement of Insurrection." Unless insurrection is redefined, there was no insurrection. Here is a more detailed legal definition of insurrection.

Black's Law Dictionary, 11th Ed., 2019.

insurrection. (15c) A violent revolt against an oppressive authority, usu. a government.

“A popular tumult is a disorderly gathering of people who refuse to listen to the voice of their superiors, whether they be disaffected towards their superiors themselves or merely towards certain private individuals. These violent movements occur when the people believe themselves harassed, and they are more often caused by tax-collectors than by any other class of public officers. If the anger of the people is directed particularly against the magistrates or other officers invested with the public authority, and if it is carried so far as to result in positive disobedience or acts of violence, the movement is called a sedition. And when the evil extends and wins over the majority of the citizens in a town or province, and gains such strength that the sovereign is no longer obeyed, it is usual to distinguish such an uprising more particularly by the name of an insurrection." Charles G. Fenwick, The Law of Nations or the Principles of Natural Law 336 (1916).

“Insurrection is distinguished from rout, riot, and offense connected with mob violence by the fact that in insurrection there is an organized and armed uprising against authority or operations of government, while crimes growing out of mob violence, however serious they may be and however numerous the participants, are simply unlawful acts in disturbance of the peace which do not threaten the stability of the government or the existence of political society.” 77 C.J.S. Riot; Insurrection § 29, at 579 (1994).

C.J.S. stands for Corpus Juris Secundum, a legal encyclopedia.

“Also it needs to be pointed out that Pelosi was warned by the FBI ahead of time that antifa terrorists were planning the attack and actually started it as well as encouraged others to take part, as shown by videos and flyers from weeks before the pre planned attacks”

This is the most hurtful thing yet, that those good patriotic people have been accused of attacking the Capital. That is as hurtful to thousands of law abiding people who love their country as it is to a single person who is innocent. they have no recourse when slandered for showing love of country and our President. I am wishing for some way for all those patriots who were in D.C. on Jan 6 to bring some sort of law suit against the democrats and the media for defamation of character. We’ve put up with this garbage for 24 years. Now we know how they did it. Voter fraud. They colluded with every devilish person or country on the planet to destroy the one thing we had keeping us a country.....our CONSTITUION.

Many of the comments here are fascinating. Thank you.

I remain bullish on America and its great Constitution, scrupulously rigorous and at the same time resilient and adaptable nearly 250 years later. We cannot be complacent, and yet the circumstances also call for trust and resolve.

We are focused, perhaps as we should be in the moment, on one skirmish or another as it unfolds. I am heartened by the larger landscape, which I believe favors freedom and progress.

Both sides have made grave errors, but the left’s are bigger, more impactful, and more frequent; and the left is determined in every instance to jump the shark, as if this is the only position to take. In so doing they dig themselves deeper and deeper into the swamp.

After their mistakes, the right seems to regroup and react well, in this instance as in many others. The leadership seems to be rising to the occasion (or to end up fully exposed and discredited, as in the case of L. Cheney). Rand Paul, Ted Cruz and various others have been wonderful spokespersons. Mitch McConnell is playing his important role, and though he should be more supportive of Donald Trump he does not deserve as much scorn as he gets on Free Republic.

The right’s base seems to me almost Zen in its good judgement and principled support, notwithstanding mistakes that can make it tempting for them to fold. The right also seems at this point well trained to tune out noise and confusion generated by the left. It is amazing to me that this support remains rock solid and even keeled when elites across the board are so collectively bent on advancing the left at all costs. (Did anyone see all of those Super Bowl ads? Remarkable!)

We need to keep our faith in our core institutions.

January 6th is about the coup-not the accused

The insurrection” is the coup. the LEFT ALWAYS accuses everyone else of that of which they are guilty. ALL THE TIME

The “insurrection” -with which they are all pointing to PDJT -was their own coup. Which means that they know there remains a legal achilles heel somewhere in that coup that potentially brings them down.

We CANNOT keep letting the LEFT define the language-which then lets them control the debate

Dated today Feb 8, 2021 Could be some new info A long read, well worth it

NEW: Pres. Trump's lawyers submit a brief saying the effort to convict him in the impeachment trial is "political theater," and the trial is outside of the Senate's authority since he's already out of office:https://t.co/7Bl0VtznTv— Alex Salvi (@alexsalvinews) February 8, 2021

I've read that certain “Constitutional experts” are claiming that even if the Senate fails to get two-thirds of members voting to "convict" Senators can still vote to bar the President from holding public office in the future...by a simple majority.

I'd be willing to bet that that's exactly what will happen. And that will be when Roberts having refused to preside will come into play...because there can be no doubt that the President will challenge such a vote before SCOTUS.

That's true. But IMO the central issue here is a vote that's likely to occur barring the President from ever holding elected office again. If,by chance, that vote occurs and the vote is to bar him from office it's hard for me to imagine him not taking this to SCOTUS. And it seems to me that Roberts' refusal to preside here indicates that the President would prevail in any challenge he might put forth.

But then I can't claim to be a Constitutional scholar.

Being a legislative body, the Senate has no ‘enforcement’ power outside its own members.

It can vote a ‘Sense of the Senate’ bill, which has no effect, just a ‘Hey, this is what we think!’ action.

If there is no ‘conviction’ in the impeachment trial, there can be no ‘punishment’..........................

we all still have 60% of the Senate and 60% of the House basically endorsing the CCP coup/insurrection... I did over estimate the Senate side....
