Trump may be making a mistake by declaring himself NOT to be the president.

Then how can he call this impeachment unconstitutional?

The Dems DO NOT CARE what is legal or not, what is constitutional or not, what is ethical or not, what is professional or not, what is sane or not.

All they care about is getting Trump and not allowing him to ever run for public office again..... ever.

They will trample the law, Constitution and whoever gets in their evil way.

They should have stopped this sham the second Roberts declined to oversee it. But they did not.

They should have stopped this sham the second the polls came out that it was unpopular with the voters. They did not.

They should have stopped this sham the second Joe Biden was installed a POTUS. They did not.

It’s going to blow up in their faces and leave them scarred forever...............................

The Party seeks power entirely for its own sake. We are not interested in the good of others; we are interested solely in power, pure power. What pure power means you will understand presently.

We are different from the oligarchies of the past in that we know what we are doing. All the others, even those who resembled ourselves, were cowards and hypocrites. The German Nazis and the Russian Communists came very close to us in their methods, but they never had the courage to recognize their own motives. They pretended, perhaps they even believed, that they had seized power unwillingly and for a limited time, and that just around the corner there lay a paradise where human beings would be free and equal.

We are not like that. We know that no one ever seizes power with the intention of relinquishing it.

Power is not a means; it is an end.

One does not establish a dictatorship in order to safeguard a revolution; one makes the revolution in order to establish the dictatorship.

The object of persecution is persecution. The object of torture is torture. The object of power is power.

Now you begin to understand me.”

A typo before they even get to the first paragraph. Nice.

It’s unconstitutional without the Chief Justice officiating.

If Roberts agrees to preside, then it’s safe to assume that Trump is indeed the “President” (there must be some reason why the lawyers used quotation marks, I’m not sure why).

But in any event, this is just Kabuki Theater. There will not be 67 votes against him, and this will all go away.

It is my understanding that the answer to your question from the framers would be that it is the integrity of our social contract with each other which upholds the limits of the Constitution. The purpose of the separation of powers is to defuse authority in the federal government so that no one branch has authority over the other. The only real “controlling legal authority” was thought to be God Himself and the vows which the legislators and judges make to uphold the Constitution. This is the essence of the social contract which has been eroding decade by decade until the last strands are now being broken. Personally, the Senate’s majority vote to go ahead with the impeachment trial even though it is clearly outside the limitation of the Constitution is a very serious, if not fatal, breaking of the social contract. Even if they eventually acquit President Trump, it will only be due to the lack of a majority vote. The precedent will be established that it is merely the will of the House and Senate which determines the social contract.

In the late seventies I had the opportunity to listen to someone who spoke on the rise of Allende in Chile. He said that Allende and his followers in their legislature continually broke laws and followed police actions that were unconstitutional. However, neither the legislature or the courts were willing to reign in the abuse of power. Even a majority in the church believed the promises of liberation theology that Allende advocated. It came to the point where there was no constitution at all, which consequently ignited a power struggle between two dictatorships: Allende and the military. He said sadly as he concluded his talk that Chile deserved to be ruled by dictatorship because. “we lost the desire to rule ourselves by law.”

Not if it's not for a sitting president. The Constitution only requires he preside for that.

True.

I am not comfortable having Bruce Castor leading his defense here....a has been from Montgomery County, Pa. There’s a reason he didn’t advance further than he did..

One theory that I like, was that if the Senate does go through with plans to impeach a private citizen, then a Bill of Attainder occurs. And if that happens, President Trump can appeal to the Supreme Court.

And that venue will be the place to specifically lay out all the mountains of evidence regarding the 2020 fraudulent election.

Great post. Stated much more eloquently than myself.

This is the clincher in your post -Personally, the Senate’s majority vote to go ahead with the impeachment trial even though it is clearly outside the limitation of the Constitution is a very serious, if not fatal, breaking of the social contract. Even if they eventually acquit President Trump, it will only be due to the lack of a majority vote. Not many seem to get how serious this situation is.

Thanks for posting this!

IMO it’s lose-lose for the deep state.

If they want to attempt to impeach, then they have to admit that Trump is still President!

At some point, this whole charade has to blow up in their faces.

The case is saying that the Congress decided he was not President. He himself is not saying that he is not President— merely that he was the 45th President. And that was under the laws of the UNITED STATES at that time. 85 plus million people do not consent to be “ruled” by these thieves. Which is why they think they have the NG “protecting” them-— from themselves.

A friend told me she’s been hearing about 10 days of darkness. Any idea ANYONE about what that means?

It means that the leader of the free world is hiding like a coward in a basement. Our enemies must be shaking in their boots.

Excellent Pleadings.

Now if the Dems and RINOS convict President Trump, he can tell Joe Biden to clear out of the White House, because they cannot convict someone who is not President.

Pense then gets to be President.

The fact that the Democrats simply do not CARE what the Constitution says and are proceeding with yet another sham impeachment out of spite says everything we need to know about this political party, how evil it is and why it needs to be opposed at every opportunity.

What evidence? Trump’s legal team had months and months to find evidence of fraud, and they came up with nothing. Every single conspiracy theory that has been put out about Dominion voting machines, ballot fraud, etc, has been thoroughly debunked.

Hi.

Welcome to FR.

What has been debunked as election fraud? The videos, the sworn testimony and affidavits?

I’ll wait...

There is not one single quart that has looked at the evidence.

Have you somehow missed that fact?

Who ‘debunked’ it, When no one saw it?

What did you make of that testimony before the Pennsylvania Legislature in which Giuliani’s statistician testified, displaying the spikes in returns that happened in the dead of night featuring a “ballot dump” with almost 500,000 votes for Biden and only 3200 for Trump?

The audience burst out laughing. Did you?
