Graham: Impeachment of Trump Out of Office ‘Unconstitutional’ — Says Speech Doesn’t Fit the Incitement Statute

Monday on FNC’s “Fox News Primetime,” Sen. Lindsey Graham (R-SC) criticized the merits of the impeachment articles brought against former President Donald Trump for allegations of incitement.

Graham said the impeachment proceedings were unconstitutional and also questioned if Trump’s remarks qualified as a violation of the incitement statute.

Has anyone talked about why John Roberts is not presiding at this trial? Has anyone talked about if this is even officially an impeachment trial, if the Chief Justice isn’t there, since the Constitution says that in a presidential impeachment trial, that the Chief Justice shall preside?

Has John Roberts said why he won’t be there?

I don’t think that they can show a string of words from Trump’s speech which looks anything like “incitement to riot”.

They may have to fall back on a penumbra or emanation from the speech. If they do that, they are free to decide a court case in any way they want. Because whatever. “It was a dog whistle, but I know what he meant, because I’m super clever.”

Impeachment requires a trial in the Senate.

The Senate committed election fraud by certifying Kamala Harris as Vice President when she is Constitutionally unqualified as a Natural Born Citizen (NBC).

In 2007 the Senate passed Senate Resolution 511 that stated John McCain was a NBC because he was ‘born of American citizen parents on a US Military base’.

Harris is an unnatural born native born of parents from different foreign jurisdictions who they were subject to by the act of issuing their passports to visit here.

All but 2 of the Senators voted to confirm Harris as VP despite their own Resolution and definition of NBC.

Propounding the lie of an unqualified candidate is election fraud.

Trump is correct. This is massive.

The best you’ll get out of the fools when you ask for exactly when he incited people to enter the Capitol is that Trump incited people over years. It’s all extremely vague and basically amounts to the argument that he made his supporters angry with his rallies. But that’s not legitimate incitement to riot. All of this is just more anti-Trump insanity.

Yes because the Constitution states the the Chief SCOUTUS will preside over the impeachment of the POTUS. Trump isn’t POTUS, so he told the Senate to pound sand.
