I don’t think that they can show a string of words from Trump’s speech which looks anything like “incitement to riot”.
They may have to fall back on a penumbra or emanation from the speech. If they do that, they are free to decide a court case in any way they want. Because whatever. “It was a dog whistle, but I know what he meant, because I’m super clever.”
I read the speech transcript from the web. Has anyone identified parts of the transcript that is blamed for inciting a riot? I have not seen any specific language identified.
