That’s where the analogy “falls apart”. But the fact is that you don’t go in, guns blazing. You exercise all possible “low impact” options before you bring out the nukes. Again, I’m not saying Trump has anything up his sleeve. Rather, I’m saying I’m not passing judgement until Biden is actually sworn in. And even then something overtly legal happening against him would not really surprise me.

There is nothing I can do about what is happening in Washington so, like everyone else, I’m just speculating about stuff.

There was one mild surprise: Some other election cases were set for conference 1/8, such as Scarnati v. Penn. Dem. Party and Republican Party of Penn. v. Boockvar. Normally a ruling on the petition is announced the following Monday morning, but those cases were redistributed to the next conference day this Friday.

It could be nothing, or it could be that someone wants to write a concurrence or dissent.
