McConnell circulates procedures for second senate impeachment trial of Trump

Outgoing Senate Majority Leader Mitch McConnell (R-Ky.) on Friday circulated to colleagues a memo outlining the procedure for holding another trial for President Trump if the House impeaches him for a second time in just over a year.

The document, which was first reported by The Washington Post, lays out how the Senate would proceed if the House approves articles of impeachment and transmits them to the upper chamber before or by Jan. 19, when senators are scheduled to resume regular business after the January recess.

He’s a private citizen when he leaves office. Where does the Constitution say a private citizen can be impeached? This doesn’t make sense.

He was convicted and removed from office. The Senate OPTED not to include the additional punishment of disqualifying him from serving in public office again.

McConnell is just covering his donkey, knowing that this impeachment crap is grandstanding...and is intended to focus attention on House Rat speechifying as to Trump’s “false accusations” of election fraud. The Rats will do any thing to take attention away from and distract any attempt to reveal their treachery.

Yes you can impeach an ex-President to remove his eligibility to run for office again. It’s an extraordinary waste of public funds and legislative time, but you can do it.

Unavoidable. Coalitions are compromises borne of individual weakness. Nobody wants a coalition. Much better to do it all yourself and reap the rewards. Problem is individual coalition members lack the numbers. Each component has just enough to be defeated one at a time. So each coalition member trims its individual goals and, after a bunch of pushing and shoving, figures out a compromise everyone can live with.

The Constitution isn’t totally clear on this, but history says a former official CAN be impeached. From Quora.com ...

However, there is some precedent for the idea. In the 1870s, Ulysses S. Grant’s Secretary of War, William Belknap, was impeached on charges of corruption and bribery. He resigned his cabinet post before the House could actually vote to impeach him, but the House went ahead and impeached him anyway. There was a lengthy debate in the Senate over whether it had the power to put Belknap on trial for the charges brought by the House, since Belknap had resigned. In the end the trial went forward, but Belknap fell short of the 2/3 majority needed for conviction even though the evidence of his corruption was clear; most of the Senators who voted against conviction did so because they believed the Senate lacked jurisdiction to try him now that he was out of office. But the fact that he was impeached and put on trial after resigning nevertheless could serve as a precedent for doing so to someone else again in the future.
