What the Supreme Court Should Say About the 2020 Election

Americans who dabble outside the mainstream media are horrified by shocking claims of election fraud in 2020. Even more horrifying are courts that refuse to address the merits of these claims -- hiding behind baffling legal terms like laches, mootness, and standing. Here is a suggested Supreme Court opinion that would end the horror and preserve our constitutional Republic.

OPINION

Per Curiam We address several consolidated cases against various states and their officials (“Defendant States”) regarding the 2020 election. The cases make one basic claim -- the 2020 election in the Defendant States was rife with voting and tabulating irregularities, illegalities, and outright fraud (“election wrongdoing”) that uniformly favored one Presidential candidate. Plaintiffs claim this violated their constitutional right to a free and fair election.

Basic Principle: Free and Fair Elections

Our constitutional Republic is founded on the Declaration of Independence which states:

[A]ll men . . . are endowed by their creator with certain inalienable Rights…. [T]o secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed. . . .” (Emphasis added.)

Government: Who Does What

The American people have seen an avalanche of punditry telling them how our government works. Many believe the news media “calls” the Presidential election. Others think this Court is a mystical, all-powerful institution that can wave its judicial wand and make everything right. Neither is true.

The United States Constitution gives the state legislatures the power to determine their election laws. Of course, they may not violate other constitutional principles in enacting and implementing those laws.

The United States Constitution gives the state legislatures the power to determine their election laws.

These legislatures should get off their asses and address the election farce in their own states. That’s pretty much what the Supreme Court told Texas when it refused to hear this last case.

Both PA and GA administered their elections under non-legislative rules, by court and consent decree. I am not sure about WI, NV, or AZ.

The six most obvious Election Theft states’ legislatures need to correct rhis farce NOW. And the case can have the Supreme Court’s “standing” by President Trump simply adding on as a plaintiff.

The most effective way to fix that is through those state legislatures, not a court challenge. In fact, a court is likely to demand a response from the legislature even if it hears the case.

Trump will have to invoke his EO and the 75,000 + “governed” patriots will have to insurrect. Not seeing a civil legal pathway to remedy the Communist theft of our free election process.

Is it not true that the Legislatures of PA, MI, GA, and WI have already announced that they do not intend to oppose the appointment of Biden electors?

I do not mean protests by some of the legislators.

It would truly be the "end of the Republic" if the losing minority in a Legislature could file a case against the majority in a court.

The Georgia Legislature should be acting today to get rid of the dominion machines for the jan. 5th runoff,announce every person in Georgia should have to vote in person must show ID no mail in votes period,send it to the Crooked governor,when he won’t sign on take him to the Supreme court, state it is the legislature that sets the rules. Period end of story

Amazing how many Freepers rail against SCOTUS as “ backstabbers” when they are doing precisely what they should, namely refusing to legislate from the bench.

Most articles in the American Thinker are of low quality.

This one is close to the worst ever. It attributes to the Supreme Court magical powers it does not have. It claims with no foundation that State Legislature appointments of Electors are not final.

If this stuff is the basis for hope the inauguration of Biden or Harris will not occur, well, I’ve got a nice bridge in Brooklyn...

We age going to do something. That is for damn sure. There are too many people content to live as slaves to the Government , rather than free self sufficient beings. History has shown that sooner or later, Governments resort to killing large segments of their populations. They use different rationales to do this but it always results in large amounts of dead bodies with the survivors being thankful that they are not one of the corpses./p>

The Court is not about to direct We the People. We create the environment around us.

What is unfolding is all about the CCP. If any real and material prosecution ever comes about-it will be in a military tribunal at this point

The CCP is desperate for resources. Oil and grain.

They have targeted America as their solution. Open warfare on American soil is not an option. Can’t place enough boots on the ground-even with Canada’s help under the table. Nukes are not an option-destroys the breadbasket.

They have targeted us from within-and part of this incremental targeting process is the erasure of our history, culture, and economic system from the face of the world.

The Communist ideology/CCP is incompatible with the American Founders and the American legal system

It is that simple.

PDJT is the only national American leader comprehending this

The States have all already legislated on matters pertaining to voting

The States effectively transferred the nuts and bolts of election procedure to election commissions. These groups selected voting machines that were corrupt and favoring Democrat candidates by design. They permitted the unfettered expansion of voting by mail .

Some groups permitted last minute changes that effectively threw the final vote totals. Those changes are apparently being litigated

Bottom line........ We must go to war to destroy Democrats and restore America. There are in fact noreal elections in the United States of America

Freepers are not asking for them to legislate from the bench. All they want them to do is uphold the constitution, you know, their actual job.

It’s over. The cheating left pulled out all stops and managed to succeed. All we can do now is survive what’s to come in the following years, and put our trust in God to protect us/provide for us.

WE allowed America to get to the broken state it’s in. Now we pay the price.

Now that I have read enough and can see the bigger picture (China infiltration) its clear they should let the states legislatures get off their ass and unravel this mess.
Trump meanwhile may need to plan a military court hearing

Mr Sanders, yes Bernie, might help defuse this for his
supporters by recognizing the Algorithms in the software
ruined any chances for many of third party candidates. Media
would surely have to report that.

Also some ballot adjudication may have happened overseas by
individuals who may not be American citizens. This would be
part of the back-filling.
