President Donald Trump will declare victory on Tuesday night if the initial results show him "ahead," according to an Axios report.
But Trump falsely saying he won early has no legal impact on the race being called and will not stop the remaining ballots from being tallied.
For over a year, the president has raised the specter of massive voting fraud and questioned the validity of absentee ballots for the 2020 presidential election. The report is based on private conversations from three sources with connections to the president.
According to Axios, Trump will declare victory "even if the Electoral College outcome still hinges on large numbers of uncounted votes in key states like Pennsylvania."
He has privately said that he would likely declare victory if he wins or holds "commanding leads in Ohio, Florida, North Carolina, Texas, Iowa, Arizona and Georgia," according to Axios.
Trump campaign senior advisor Jason Miller did not show any signs of hesitancy on the president's chances, saying that he "will be re-elected handily and no amount of post-election Democratic thievery will be able to change the results."
Tim Murtaugh, communications director for the Trump campaign, told Axios that the report was "nothing but people trying to create doubt about a Trump victory."
He added: "When he wins, he's going to say so."
Many states will not be done counting ballots on Election night, including the critical Midwestern battlegrounds of Pennsylvania, Wisconsin, and Michigan.
The Trump campaign did not yet respond to Insider's request for comment.

Joe will also declare himself the winner, even if he is behind. His claims will carry legal weight, and it will be outrageous and racist to question his claim.
Apparently, the SCOTUS will need to step in and declare Trump the winner... The media will never admit that they have been fools and fooled for the past 4 years by their own hatred and stupidity.

Democrats will try to recount till they have found enough car trunks full of votes to give them the results they want.
While we like to see the rituals in elections, of a candidate speaking to supporters and claiming victory, or of a losing candidate conceding an election, such concessions, or declarations of victory, are legally meaningless.
Exhibit A, is Stacy Abrams in Georgia. She never conceded defeat in that Georgia governor election two years ago. Yet the declared winner Brian Kemp has been governor all this time. It’s just ceremonial if a candidate claims victory or concedes defeat. The votes still need to be counted. The election officials in each jurisdiction still need to officially sign off on the official results to make everything legal.
This tells me the media know the real polls, early voting, and vote by mail trends. They are on defense.

Well, isn’t that what the norm is..but when it comes to the commie media, the plan is, that after 1 week when all the fraud is counted, then Biden “wins” they can say “See Biden really won”
Mrs. Bill Clinton ordered him not to concede under any circumstances.
These so-called fake news stories always blather about “what is Trump going to do on election night”.
They never mention what Biden is going to do.
If he actually wins, he’s not falsely claiming it.
Actually they can’t label him falsely saying it, as if he has way more than 270, its fact. If too many are still counting at that point no one can say right then its false, the counting is still ongoing. At the current counts he’d be true to say it.
When President Trump is ahead by 2 or more percent by 9:00 PM Pacific time and declares victory, a Democrat move, at that point, to steal the election would be a distinct health hazard.
