A federal court Tuesday night upheld a challenge to the Trump administration's asylum restrictions, specifically a 2019 rule that requires seekers to ask for asylum closer to home.
U.S. District Judge Timothy J. Kelly of Washington, D.C., ruled in favor of immigrant nonprofits and asylum-seekers who argued that the rule known as the "third-country asylum rule," which was jointly published by the Justice Department and the Department of Homeland Security, violated the Immigration and Nationality Act.
Kelly, who was appointed to the federal bench by President Donald Trump in 2017, agreed that in adopting the policy, the administration did not abide by the federal Administrative Procedure Act, or APA, which requires that Americans be given enough time and opportunity to weigh in on such rule changes.

But in thinking about it this is a rule, not a law. I know I have complained about many BS GVT rules.

It sure looks like the judge provided a path to slow-walk a new version of the “rule.”
If the process starts over again in response to the judge’s finding, it looks like it pre-empts others from jumping onto another anti-Trump bandwagon.
Note it’s a procedural problem, not the rule. And the rule is based on UN consensus. Might that be a treaty?
This applies only to asylum seekers and 95% or more of them are refused asylum afdter they have their hearings. I see nothing here that changes the procedure forcing the asylum seekers to wait for their hearing in Mexico and not here in America.
Asylum seekers are NOT the same as illegal aliens who illegally sneak over our border. My understanding is that flow has been drastically cut.

And thank God for that. This ruling is fine. Its the law or at least a rule that must be abide by. Arent we always complaining that judges make up there own rules? This one didnt. You should be happy.
Like I said....other deals were made with those countries and that rule is a nothing burger at this point.

It is what the Roberts used to justify ruling against Trump in the DACA decision and adding the immigration question to the Census.
Much of it is subjective, such as "Did the administration show sufficient reason for changing a rule.
It is the administrative Deep State ruling against the Constitutional powers of the executive branch.
Immigration is in the purview of the executive, not the judicial branch.
