As a Pasco County Sheriffs Deputy, Sean Kennedy spent 25-years following the law and enforcing it. Now hes found himself in a position where he feels he must break the law. More specifically, a by-law for his community association.
Kennedy lives with his wife and children in the Foxwood subdivision in New Port Richey. Its a deed-restricted community where lawns are neatly mowed and cars are parked in garages.

The flag looks just like an American flag with the exception of black stripes and a blue stripe for law enforcement and a red stripe for firefighters.
People dont really understand that flag. Its nothing to do with police, said Kennedy. Its police that have been killed. The meaning of the flag is to support police that have been killed. Not police that are active right now working.
Neighbor James Adams doesnt understand why the association is all of a sudden asking Kennedy to remove the flag.
I understand that there are certain guidelines and bylaws that we have to follow, said Adams. But thats a little much.
Kennedy believes he understands the timing. A member of the association told him someone complained. I think its self-explanatory whats going on in the world., said Kennedy. The hatred of the police because of one horrible action by a guy in Minnesota just tarnishing everybody.
Kennedy says a number of neighbors have weighed in and support his right to fly the flag. He says he has no intention of removing it.
Im not taking it down. Its something Ive worked for for 25 years and I believe in, so, and its definitely not racist, its definitely not hatred, said Kennedy. Its a tribute to law enforcement officers and firefighters who died.

How quaint you are - file a lawsuit and they still have to expend resources they don’t have. Put them through something they’ll never forget. When they put out the next financial report and the residents see they spent 100k on defending a stupid decision - they’ll be the ones moving out.

You think HOAs are bad, wait until you have to deal with Zoning and Code enforcement, and those guys have real arresting powers unlike the HOA Karens do
Any HOA that is run by even marginally competent people would not back down if the law and their governing contracts are on their side.
And the threat to sue board members individually is meaningless. HOA board members in every state where I've worked are indemnified against lawsuits ... so unless there is criminal activity or fraud involved, then they won't lose even one penny out of their own pockets. Not only that, but the HOA is obligated to pay their legal fees to defend themselves, too.

If you buy into a place with HOA you are buying into many restrictions.
How would you Freeepers feel if you had your double wide next to someone who was flying a BLM flag? A Pride Flag? etc. I’d be steamed and ashamed. Trust me,I’m in ultra lefty hood in summer, banners here make me sick.
HOA where I lived allowed 2 flags. American and Canadian (half the place was Canadian snowbirds).

I don’t consider my house an investment. I plan on living in it until I die. I wish my house was worth $5 dollars. The property tax and insurance would be really low. If it burnt down, presumably I could by one like it for $5 dollars. It is sort of like socks. What difference does it make if my socks are worth $1.00 or $100,000 if I don’t plan on selling them and not replacing them.
I don’t blame the HOA’s; if you sign a contract to behave / maintain your property in a certain way I expect people to live up to their signed contracts.
My nearest neighbor is 2 miles away (I live in the real boondocks), I don’t bother him/he doesn’t bother me.
Personally I would never buy into an HOA area, but I understand the people who do.
Those could have been taken care of by local code enforcement - they are here in Dallas, for example.
HOAs mostly don’t do anything except infringe on people’s rights, from what I can see.
It is a choice-I live in a rural area where all lots are a few acres and no HOA, because I choose to do so-raised in the country, i do not like to live in cities a mere few feet away from a neighbor I may not like or want to be around-but I don’t call a fellow conservative an idiot because they like living in a city or burb with an HOA-that would just be arguing over geography, and it makes no sense-I’m not a Karen-live how you choose, where you like-HOA, no HOA, rules and restrictions, or none and neighbors with any building/livestock/home-based business they want, like things are out here...
My 1st hubby and I lived in a neighborhood in a burb that had an HOA-that was about 40 years ago-both of us were ranch kids, so we felt crowded and watched the whole time-we sold that house in a couple of years, moved further out where there was no HOA, no burb-I haven’t lived in a city or a burb-and no HOA-since-but I’m not the type who gets the rat’s ass over what my neighbor does with his/her own property-not my business as long as a major crime is not being committed-like murder-and it helps to have the neighbors an acre or two away, across a nice 6-7 ft. game fence. The only thing you have to do to get along here is mind your own business unless asked for assistance...
That’s what I’m doing, but HOAs as they exist now need to be banned. They’re kind of like unions in the era of OSHA if they are in an area with established code enforcement - rather pointless.
Zoning and code enforcement don’t get to arbitrarily pass new regulations and ‘forget’ to notify people about them. Also, they are bound by more laws and the appeals process is entirely more fair.
Well we live in a small subdivision on a 1200 acre lake. Beautiful 1.5-2acre lots with 300-400 feet of shoreline.
Median house is 3/4 to 1 mil and we can’t afford people doing blatantly stupid things like building a pole barn etc.
It would be akin to putting and outhouse in your front yard and real estate value would suffer substantially.
With all due respect you are most certainly the exception rather than the rule.
He chose to live there and by doing so accepted its restrictions. STOP STICKING UP FOR PEOPLE WHO LIVE IN HOA’S. It’s a personal choice not an imposition.
