Judge Sullivan does the equivalent of pasting 'I’m guilty' on his forehead

From the beginning of the Michael Flynn case, Judge Sullivan has been hostile to Flynn. By December 2018, based upon a misreading of the facts, Sullivan accused Flynn of conduct amounting to treason and said that he felt “disdain” and “disgust” for what he believed Flynn had done.

Sullivan’s behavior, however, went from hostile to bizarre when the Department of Justice, having uncovered massive wrongdoing the FBI’s and DOJ’s handling of the Flynn matter, moved to dismiss the case. On Saturday, though, Judge Sullivan managed to escalate from bizarre to . . . well, maybe paranoid is the correct word.

A Motion to Dismiss a criminal case is a routine procedure when the government realizes, for whatever reason, that there is no further reason to prosecute a defendant. Because the Constitution gives the prosecutor sole discretion about whether to bring a case and then, having brought it, whether to miss it, the judge has a limited role – and that role is to protect the defendant.

Thus, it is the judge’s responsibility to make sure that the government isn’t toying with the defendant by dismissing a losing case while intending to refile in the hopes of drawing a more amenable judge or jury. Absent that problem, the judge’s only job is to rubber-stamp the dismissal.

Judge Sullivan refused to use that rubber stamp. He also declined to act as Flynn’s last defense against an overreaching prosecution.

Why did the appeals court not just end it? Because they are trying mightily to give Sullivan an out, however idiotic.

In that sense the appeals court is complicit in enabling clearly politically driven behavior. Why allow two weeks for a response when the matter should have been swiftly dealt with and the judge put in his place? Such decisive action would have the salubrious effect of sending a message to other would be rogue judges and discouraging such behavior instead of tolerating it.

At first I thought the appeals court was giving Sullivan a way to gracefully extricate himself from a situation of his own making, but there is no legitimate reason to extend this idiotic judicial mess out like this other than to semi-legitimize it.

This is a disgraceful episode in American justice, or what’s left of it.

The GOPe not naive. The GOPe are true believers in unfair trade and open borders. And they know in another decade or two the Uniparty population replacement plan will be complete and 250 years of our American heritage will be in the dustbin of history.

This judge is compromised. Someone else is pulling his strings. Bribes, blackmail, whatever leverage is being used doesn't matter. Whatever it is, it's substantial. So much so that the judge doesn't care that he is shredding his reputation. He'll never get that back. And he doesn't care, he just fights like Flynn murdered his mother and he wants revenge no matter what.

There is no level this judge won't stoop down to in order to nail Flynn and he doesn't care who knows. He's daring the higher court to order him to stop. I wonder if they have the stones to do it or if the usual 'we don't embarass our own' old boys network stuff saves Sullivan and dooms Flynn?

Something very big is being covered up, something that Flynn either knows, or, once freed of the court he will have the means to expose.

If I had to guess, somebody high up ordered the murder of Seth Rich, and, while the materials in evidence will not expose that, a proper investigation of materials in hand will, like pulling on a string, will unravel the whole ball of twine.

There's really nothing else about the past administration that could be worth paying the price they are paying now and running the risks they are running.

The GOPe does love unfair trade and open borders. I agree with you about that, but WHY is another question. My theory is that its explained by a combination of greed and naivete. They want the short term economic benefits for themselves and their constituents and conveniently ignore the long term consequences.

Some genuinely and naively believe that what they’re doing is good for the country; others may have more malevolent and greedy designs and don’t give a damn how it effects our future.

I also place blame on the GOP as a whole, not just the GOPe because its the party that keeps putting these people in positions where they can damage the long term interests and security of the country. In that sense the party is the enabler.

Sullivan’s appointment was a clear case of virtue signaling and sucking up to the quota crowd.
Same can be said for Susan Rice and a long list of unaccomplished political hacks who do not have the basic intelligence, but do have the desired skin color.

With respect, he has been a federal judge for more than 25 years. He has written hundreds of opinions. On the whole, he has a reputation as a fair and capable judge, who is especially concerned about government overreach and the rights of the accused. That record does not match what he is doing in this case.

He is not being asked to represent himself. He is merely being asked to explain his thought process as to why he refused to dismiss the case as requested by the prosecution.
He needs another lawyer to explain how he made his own ruling?
