Flynn Sentencing Scheduled for Jan 28th

A federal judge on Monday rejected Michael Flynn’s attacks against the FBI and the Justice Department, setting a long-delayed sentencing for President Trump’s former national security adviser for Jan. 28.

U.S. District Judge Emmet G. Sullivan of Washington, D.C. dismissed Flynn’s motion to find prosecutors in contempt. In a 92-page decision, Sullivan ruled there was no basis for Flynn’s allegations that federal law enforcement officials entrapped the retired three-star Army general into accepting a plea deal and that special counsel Robert S. Mueller III’s prosecutors had not wrongfully held back 50 requests for evidence from Flynn’s attorneys.

If Sidney Powell decides to appeal all the way to the Supreme Court, Flynn might die before we ever here his side of this sordid story.

If Judge Sullivan is so certain the Government did nothing wrong, why does he need another six weeks to decide on a sentence? Seems odd to me. The wheels of justice are grinding to a halt.

I have made my views about Powell known on this site previously. Her representation of Flynn was reckless and incoherent. If he is sentenced to a long incarceration instead of the probation he was promised originally, you can give “credit” to Powell.

The recklessness of her representation has had only one beneficiary, Powell.

I feel bad for Flynn, but he was given horrendous legal advice. And the point of the reckless advice, apparently, was book sales, go-fund-me cash, and fame.

I appreciate why people adored Powell the way they did, but they were wrong about her. Her argument was legal nonsense, which she surely should have known. Now Flynn might very well pay the price as she sails away on her golden voyage.

The FIB needs to join the 21Century and be required to record and tape interviews. We have learned that their current methods are subject to fraud.

Let us not forget that Sullivan called Flynn a traitor at the start of the trail. He walked it back some, but the traitor comment travel around the world on every news outlet. Next, if Flynn was truly setup, why is Barr allowing this travesty to continue. Barr surely has read the IG report and knows more outside the confines of it.

I never had faith in Barr to do the right thing, even though some of his statements have provided some hope, doubt lingers. Not one current working FBI agent in the IG report has faced discipline, much less arrest. Every co-conspirator still the FBI is untouched and free to run an operation against the President again.

Agreed. A better idea would be to not talk to the FBI without legal counsel present.

Better than that, don't talk to them at all.

That was Martha Stewart's mistake.

If Judge Sullivan is so certain the Government did nothing wrong, why does he need another six weeks to decide on a sentence?

1. He's probably got a dozen or more active cases on his calendar.

2. Both sides are given time to prepare statements at the sentencing hearing.

Why can’t Flynn withdrawal his guilty plea based on evidence of altered 302s. Take the case to trial.

Chances are the prosecution will not proceed to trial and charges will be dropped.

Did the judge not think the modified 302’s were significant?

He said the changes made weren't material. I thought the same thing when I saw them.

It wasn’t at the start of the trial. It was at the sentencing hearing and he apologized.

Probably even worse but of a piece with her MO, Sullivan raised ethical concerns as it seems part of her appeal was plagiarized.

That's what he asked to do, and the judge just turned him down.

The judge found the edits to the 302s to be immaterial. Also, when Flynn pleaded guilty, the judge put him under oath and had him admit that he deliberately lied to the FBI. Pretty hard to withdraw a guilty plea after that.

Next, if Flynn was truly setup, why is Barr allowing this travesty to continue.

1. Because maybe he wasn't "set up" the way everyone here seems to be assuming he was.

2. There's no reason to expect the U.S. Attorney General to intercede in a case on behalf of a defendant whose legal strategy may be idiotic.

1. There was no trial (I assume you mean that instead of "trail!")

2. Sullivan made this statement at Flynn's prior sentencing hearing months ago. He walked it back at the same time he made it pretty clear that he didn't think Flynn's guilty plea was in Flynn's best interest.

Because Sullivan said the changes to the 302s weren't significant.

The documents have been posted here before and the changes look to be just routine edits for clarity.
