The only mistake made vis a vis Mr Dershowitz is his embrace by “conservatives” who will lap up any argument made by someone who pretends to be on their side.

I thought the law is worded that only Congress can override the declaration of the National emergency. Am I wrong?

I disagree with Alan on this one. As President he has swore to protect the citizens of the United States and thus has constitutional authority to call a national emergency.

And no a Democrat President cannot call for gun confiscation via a national emergency because gun ownership is a constitutional right, and the President cannot declare a national emergency in violation of the constitution.

No, when he speaks rationally we agree, when he speaks irrationally we disagree. He is speaking irrationally and conservatives will disagree. Unless you are talking about so called conservatives, such as some talking heads have positioned themselves as being conservative, which proves they are not really conservatives at all.

It will be interesting to see what meaningful legal arguments they devise to oppose the President’s clear statutory authority. I suspect it will be similar to the Travel Ban: they’ll claim he’s only building a wall to exclude protected-class foreigners from entering the USA at will...people of color, women, medically-challenged, gender-confused and LGB on the QT folks.

I think emergencies are things that happened suddenly.

Faulty reasoning - like saying ignoring a spot on the skin for long enough to have it develop into widespread melanoma can't be an emergency situation because it took a while for it to become embedded and deadly....

Trump may have sabotaged his own emergency order by saying (words to the effect) “I could have done this (build the wall) over a number of years.” We have seen federal judges point to Trump’s political rhetoric before in their past rulings. There’s an old saying in politics, “you can have your way, or you can have your issue.” IMO, Trump wants the issue.

I agree, a thoughtful conservative would not be overly influenced by Dershowitz.

I do think he is being force fed by the media, and there is no appetite for him outside of the tv studios.
