Supreme Court sides with Planned Parenthood in funding fight [Roberts, Kavanuagh join libs]

The Supreme Court Monday rebuffed efforts by states to block funding to Planned Parenthood.

It left in place two lower court opinions that said that states violate federal law when they terminate Medicaid contracts with Planned Parenthood affiliates who offer preventive care for low income women.

It would have taken four justices to agree to hear the issue, and only three conservative justices -- Clarence Thomas, Samuel Alito and Neil Gorsuch -- voted to hear the case.

Chief Justice John Roberts and Justice Brett Kavanaugh appeared to side with the court's liberals in not taking up the case -- showing an effort to avoid high-profile abortion-related issues for now.

Roberts and Kavanaugh "likely have serious objections," said Steve Vladeck, CNN Supreme Court analyst and professor at the University of Texas School of Law. "But such votes seem to be a signal that they would rather avoid contentious, high-profile disputes for now, at least where possible."

The case concerned whether states can block Medicaid funds from Planned Parenthood affiliates that provide such women with annual health screens, contraceptive coverage and cancer screening.

Are you saying the court will rule that States can't terminate contracts of health care providers that break the law and defraud Medicare/Medicaid?

Here is a hint: they already do and PP was busted already. Giving cover to Roberts and Kavanaugh is pathetic (If they deny another case dealing with this issue).

This was just over ‘the right to sue’.

From the dissent:

“whether Medicaid recipients have a private right of action to challenge a State’s determination of “qualified” Medicaid providers under 42 U. S. C. §1396a(a)(23) and Rev. Stat. §1979, 42 U. S. C. §1983. Five Circuits have held that Medicaid recipients have such a right, and one Circuit has held that they do not.* The last three Circuits to consider the question have them- selves been divided.”

They Supremes did not rule in the issue.

They just declined to clarify the right to sue.

This is a nothing burger.

Kavanaugh dissented on the decision that allowed the 17 year old illegal to get a free elective abortion. I think we are good with Kavanaugh and have a little patience.

Gee v. Planned Parenthood of Gulf Coast and Andersen v. Planned Parenthood of Kansas and Mid-Missouri were lower court rulings that states cannot ban Planned Parenthood from receiving Medicaid reimbursements when they treats low-income patients. A number of states had sought to institute bans in recent years.
Medicaid dollars cannot be used for abortions under federal law. As of today’s ruling those lower court decisions wilk stand.

There is an amendment to our Constitution authorizing the feds to collect taxes from us in the manner that they do.

There is not an amendment to our Constitution requiring the feds to give states money that they can spend other than how Congress specifies.

That’s not the way Planned Parenthood sees it. The states of Kansas and Louisiana wanted to be able to stop all Medcaid funding to Planned Parenthood. Since the Supreme Court is allowing lower court rulings to stand, those states will not be allowed to stop Medicaid reimbursements to Planned Parenthod.

Ahh....no. More likely WISELY waiting for an additional conservative Justice to be appointed. Remember, Roberts is “shaky” and possubly compromised.

He could have sided with the conservative Justices!!

No final ruling has been made.

All that has been decided so far has been the right to sue.

And the preliminary injunction.

Well the new justice is now 0 for 1 as far as I am concerned. Roberts, well, we all know how he voted for Obamacare, so no real surprise by that fool. I do not consider Roberts a conservative. He is not like our true conservatives on the court.
