The Justice Department responded to CNN's lawsuit over the revocation of Jim Acosta's press pass on Wednesday, saying in a court filing that the White House rejects the idea that it can't pick and choose which journalists can be given a permanent pass to cover it. "The President and White House possess the same broad discretion to regulate access to the White House for journalists (and other members of the public) that they possess to select which journalists receive interviews, or which journalists they acknowledge at press conferences," lawyers say in the filing.
Both CNN and Acosta are plaintiffs. The suit alleges that their First and Fifth Amendment rights are being violated by the ban.
Judge Timothy J. Kelly, a Trump appointee, has scheduled a hearing for Wednesday at 3:30 p.m.

What bothers me is, that if the courts rule against him, Trump might comply.
He should cut to the chase and let the powers that be know that he alone controls who enters the White House. And they can all go pound sand.

Their brief by Olson refers to president Trump as a politician not as president. The article cites judge Napolitano among others stating that CNN will quickly win the lawsuit.
I wonder how Fox News would recommend the handling of an out of control reporter. Every news conference would become a debate and the reporter would become the center of discussion. Should the President simply stop news conferences and instead do one on one with select reporters?

Even if he is allowed back in, nothing says PDJT has to let Acosta ask questions, Just ignore him and call someone else. If Acosta continues to interrupt, show him the door.

You noticed they point out who appointed this judge. I had just commented on the Georgia gubernatorial election where two Obama appointed federal judges are letting the Democrats count ballots missing Identifying information. Do you think the press in Georgia tell us the judges are Obama appointees? No of course not! But they should.

It’s not like the White House needs to have press meetings. Just shut them down if CNN wins (which they obviously shouldn’t...being allowed to ask the President Questions isn’t a right)

Replace it with:
1. Ask through the WH website questions from not only the network “newesies” but from everybody.
2. Assign a number to them as they come in then rank order them as a function of “issues-of-the-day” e.g., Chinese trade violation North Korea, etc., points the WH wants to emphasize. Select 100 randomly from this list. Put on a DVD, with a pdf summary. Make it available in WH press room and make it all downloadable from the WH web site.
The question that didn’t make the list will be answer in due time.
3. The network newsies can agonize over the answers and navel gaze about them to their hearts content on their own network shows. Let’s see if any one watches!
4. Do the equivalent of “FDR Fireside chats” on network TV & very important - YouTube! The Rats can buy time on network TV and give their counter. Again lets see who will watch. (Harder to counter the YouTube, but they’ll try. Lets see how many likes, downloads etc. they get!)
There is no Constitutional requirement for the WH Briefing1
we delude ourselves into thinking its something like “Prime Minister Question Time” in Parliament. Even that’s ridiculous for this modern communication age!

... AND the same broad power to have or NOT have press conferences (and if courts rule against them, press conferences should end until that ruling is reversed).

Pretty simple, bar the “accoster,” give the commie news network another pass for a different reporter, and publish a set of minimal guidelines to cut back on the rudeness.

NO MORE WH PRESS CONFERENCES. Trump should take a page from the Obama Playbook. Trump should just tweet out the truth and let the chips fall where they may. As long as Trump has these Press parties, they can report he said all kinds of things he never said.....so just stop them right now.
