The Trump administration is considering narrowly defining gender as a biological, immutable condition determined by genitalia at birth, the most drastic move yet in a governmentwide effort to roll back recognition and protections of transgender people under federal civil rights law.
A series of decisions by the Obama administration loosened the legal concept of gender in federal programs, including in education and health care, recognizing gender largely as an individual’s choice and not determined by the sex assigned at birth. The policy prompted fights over bathrooms, dormitories, single-sex programs and other arenas where gender was once seen as a simple concept. Conservatives, especially evangelical Christians, were incensed.
Now the Department of Health and Human Services is spearheading an effort to establish a legal definition of sex under Title IX, the federal civil rights law that bans gender discrimination in education programs that receive government financial assistance, according to a memo obtained by The New York Times.
The department argued in its memo that key government agencies needed to adopt an explicit and uniform definition of gender as determined “on a biological basis that is clear, grounded in science, objective and administrable.” The agency’s proposed definition would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with, according to a draft reviewed by The Times. Any dispute about one’s sex would have to be clarified using genetic testing.

Biological science doesn’t tell us %#&%^ about genders. It tells us about sexes. Two, neither more not less.

Biological science recognizes 2 sexes and rare hermaphrodites (what is now being called intersex).

First, this was solid, selective leaking by President Trump. It's built on good bones (uh, yeah), and has already thrown the Left into a tizzy.
However, second, this swims upstream against the last 5 years of stare decisis -- but stare built from mud cases built at the Federal level that SCOTUS has rarely deigned to capture.
Well, the 4 Libtards on SCOTUS will regret letting all those 9th Circus decisions stand without comment viz this gender garbage, now that Becket Fund or Thomas More or Judicial Watch will have a 'standing' platform to pursue a strong, actually the best case against DHHS and at least straighten up (*snicker*) Title IX for a generation or two.

These pukes can’t even give a simple report without lying. Gender is determined by chromosomes, not genitalia.
This is the question I always ask liberals in regard to the transgender nonsense. If there was an explosion that blew said person to bloody unrecognizable pieces. A piece was taken to a lab and DNA wa extracted what would it say? Male or Female? Usually they start sputtering and try to claim that is not important! Its what the person’s mind percieves himself to be! I then counter with - ‘John Nash’s mind once told him he was Emperor of Antarctica!’ Was he ? Did he abdicate later and go back to being a mere Princeton math professor?
Usually then they get mad at me and walk away.

“Genitalia” is just one external expression of something that goes far deeper, into the nervous and endocrine systems at least, and probably others I’m insufficiently aware of to mention, down to the cellular level.

I look at it this way: the use of the word gender is a defacto confirmation that they are knowingly playing word games. If it were really about biology, they'd use the word sex. They also wouldn't have to invent new gender words and then use them to bully people.

I hate that term, “gender.” Call it Sex, which is the term on the birth certificate. Your sex is either that of a male or female. Or, let’s get real specific and say you are either XX or XY.
To me, gender is a social engineering construct designed to confuse even the brightest liberals into believing that biology and sociology are the same thing.
