"The replacement of government appointees is largely governed by the rules set forth in the 1998 Federal Vacancies Reform Act. This law gives the president the authority to temporarily move any one of his Senate-confirmed political appointees into a position that is vacant, provided the person who leaves the positions "dies, resigns, or is otherwise unable to perform the functions and duties of the office." The law specifically does not say "dies, resigns or is fired."

If RR resigns, Trump can move someone already confirmed by the Senate in the Deputy AG position and doesn't need the Senate to confirm.

My guess is RR will be a prick and not resign but force Trump to fire him.

Trump does not need to fire him. Once FISA is Declassified then he will have no choice but to fire himself.

Does that include judicial appointees? If Kavanaugh gets dumped by Senate, make him Deputy AG. I imagine he'd like a chance to pursue justice with vigor after what's been done to him by the left.

pay him a ton of money, give him a desk, and phone, and zero responsibilities.

Sounds just like Sessions. You know, the rat bastard that hired rosenstein. Almost like this coup was coordinated from the get-go /said over a year ago.

I do believe if he’s fired he gets his pension.

If he resigns he doesn’t.

The IG is declassifying the Fisas etc.. the IG is the one telling RR he needs to resign. Has nothing to do with the NYT article.

As part of Trumps Nomination process he should require an undated resignation letter from everyone, including military flag officers. That would solve the issue.

this is a non-issue.

Normal succession would place Noel Francisco, the confirmed Solicitor General over the Mueller probe.

Mr. Francisco was confirmed by the Senate in September 2017 on a narrow 50-47 vote, that fell largely along party lines. He once clerked for the late Supreme Court Justice Antonin Scalia, whom he referred to as his “dear mentor,” during his Senate confirmation.

We WANT this guy.
