The fate of Deputy Attorney General Rod Rosenstein is reportedly hanging in the balance.
It was unclear whether or not Rosenstein, who oversees major parts of the Justice Department, including the special counsel's Russia probe, would keep his job. Amid conflicting press reports Monday, the White House said Rosenstein will remain in his job for the time being, and he will meet with the president one-on-one on Thursday.
If Rosenstein were to depart, it was also unclear whether he would be fired, or he would resign. In Rosenstein's case, this could make a big difference as to whom Trump can select to replace him as deputy attorney general.

If RR resigns, Trump can move someone already confirmed by the Senate in the Deputy AG position and doesn't need the Senate to confirm.
My guess is RR will be a prick and not resign but force Trump to fire him.
So demote him. Move him into another position. He doesn’t get to keep the position indefinitely, does he?
The law specifically does not say “dies, resigns or is demoted.”
I demand an investigation by the FBI into Rod Rosenstein.

Trump does not need to fire him. Once FISA is Declassified then he will have no choice but to fire himself.
IMHO, it is not the POTUS RR has to worry about — it is the IG.
Does that include judicial appointees? If Kavanaugh gets dumped by Senate, make him Deputy AG. I imagine he'd like a chance to pursue justice with vigor after what's been done to him by the left.
PROMOTE Rosenstein to some manufactured cabinet position.

You are splitting non-existent hairs. He can fire someone who serves at his pleasure and the same rules apply. RR is “otherwise unable to perform his duties”
Nope pension rights accumulate with time in service regardless of the circumstances under which you leave service.

Remember when RR referred the FISA-spygate issue to the IG for review? That’s right...The IG is a whitewash for the corrupt state. RR knew the IG had his back otherwise he wouldn’t have done it.
Yeah, I suppose it doesn’t. I’m just really aggravated that these holdovers are clearly wreaking havoc and they serve at their own and the media’s pleasure, not the President’s.
The IG is declassifying the Fisas etc.. the IG is the one telling RR he needs to resign. Has nothing to do with the NYT article.
