I think Burr was charged with treason for planning an attack on DC. There was no declared war, but Burr wanted to amass an army (men and arms) to attack. I think they did not have two witnesses of the same act though they had 2 witness of different acts of "planning war" on the US so he was not convicted. Even if I'm wrong, congress doesn't need to declare war for someone to be charged with treason.
