WaPo: Brett Kavanaugh could drastically shift the court to the right. The Senate should take care.

Judge Brett Kavanaugh’s nomination to replace retiring Justice Anthony M. Kennedy on the Supreme Court comes at a tense moment. It could drastically shift the court’s tenuous ideological balance, and it comes not long after Senate Republicans disgracefully blocked President Barack Obama from making a court pick in his final year. More than ever, the court is in danger of becoming viewed as an instrument of politics rather than an independent, nonpartisan branch of government.

That is why senators must be even more exacting than usual when they evaluate Mr. Kavanaugh. They should insist on a justice who would rule with modesty and genuine independence of mind — and a willingness to resist abuses of power by this and future presidents. “I believe that an independent judiciary is the crown jewel of our constitutional republic,” Mr. Kavanaugh said following his introduction. He must show he means it.

Mr. Kavanaugh meets the basic qualifications for high court service. A Yale Law School graduate who clerked for Mr. Kennedy, he has served for 12 years on the powerful U.S. Court of Appeals for the District of Columbia Circuit. The country certainly could have expected worse from President Trump. Yet Mr. Kavanaugh came from a list of potential nominees preapproved by conservative activist groups. Their goal is to tilt the court as far right as possible as quickly as possible.

Mr. Trump’s first nominee, Neil M. Gorsuch, was, in his confirmation hearings, the least forthcoming Supreme Court nominee in recent memory. Mr. Kavanaugh must do better. Fortunately, he comes with a huge record.

I think it reasonable to believe the “point after which everything went to h311” so far as the US Supreme Court is concerned would be Baker v Carr.

That one got decided in 1962. Justice Frankfurter warned the Court it was “getting into the political thicket.” His “revenge” came in 2000 when the courts had to figure out if GWB or AlGore won the election.

Yes. Who gives damn what the Wash Post thinks (and I use the word “think” loosely).

They had no problem endorsing Ruth Bader Ginsburg, as far left a justice as ever has sat on the SC. Her record is exactly parallel to that of the Communist Party on many of their positions. Paint her Red.

Kagan - OK for a lib but not my preference re any judicial balance in her though processes.

Breyer- far-left loon.

The Wash. Post didn’t oppose Sotomayor for her “racist” comment about being a “proud Latino woman” instead of saying “a proud American woman”.

Talk about hypocrisy. It is alive and well at the Wash. Post, and for those of us who read it during the Vietnam War (and Cambodia/Laos wars), we know that you secretly favored the North Vietnamese communists because you never opposed their naked and covert aggression throughout SE Asia including Thailand.

Nor did you oppose their genocidal extermination policies after the war ended, costing an estimated 2-2.5 MILLION lives plus the imprisonment and torture of hundreds of thousands, if not more than a million, who survived their slave labor camps.

The Washington Post has as much blood on its hands and writings as had the New York Times denying (or refusing to cover), the Ukrainian Famine/Holomador genocide and the Holocaust of European Jews, Gypsies (esp. the Roma), homosexuals, the White Rose resistance group, anti-Nazi Christians, Poles and political prisoners.

The Washington Post can never “wash” away the bloodstains, journalist lies and propaganda, and biases that have been their hallmarks since the 1960’s.
