Fmr. NFL Union Head: Players’ Right to Kneel “Supersedes” League Rules

George Martin, the former head of the NFL players’ union, seems confused about the Constitution. Martin was interviewed on CNN this morning regarding the new NFL rule pursuant to which teams can be fined if players kneel during the Anthem. When Chris Cuomo pointed out that “the league is a private concession; they can make their own rules,” Martin responded:

“I think they have the right to make those rules. And I think we have the right to either adhere to them or not. And I think that our right supersedes theirs.”

And your employer has the right to fire you for breaking their rules. The duty, actually.

Most Black Americans on our media are quite disappointing. They so often demonstrate their ignorance and lack of education. So sad.

The players do have the right to kneel in protest. However they dont have a right to remain in the league when they dont comply with the leagues rules.

I wish I had been a football fan, then I could stop watching. Thing is I never watched before so it is hard to boycott. I also wish I had been a season ticket holder, I would have surely given them up too.

Collective bargaining agreement, they’re union.
The NFL would have to put that into the next contract.
The NFL will back down to the union.

That is a good one. Other thoughts could be:

-5 yard penalty for each team member that kneels, assessed at opponents option.
-If more than 5 team member kneel, award opposing team 3 points. If entire team kneels, award 7 points to opponent.
-If any team members kneel, remove one time out, assessed at opponents option for either the first or second half of the game.
-If entire team kneels, remove kneeling teams cheerleaders from the field.

You’ve got a point about the union. And not just in the NFL’s case. Union members can get away with politicking while salaried employees are told don’t do it.

If the union’s agreement hamstings the league, fine by me. The NFL will circle the bowl faster.

The 15 yard penalty rule is useless. What will prevent players from colluding with each other so that both teams protest and both teams are assessed the same penalties, in effect cancelling them out ?

No, he’s correct. The players are union and there’s already a Collective Bargaining Agreement between the players and the owners.

That language will have to be inserted into the next agreement. The league is pretending to care to keep fans. They know there is no way to enforce this.

Fine, then they can accept the responsibility of getting fired as long as we are standing on principle.
