A Manhattan judge has ruled that a bar that ordered patron who was wearing a "Make America Great Again" hat to leave had a right to do so under the New York constitution.
The judge rejected Greg Piatek's argument that he wore his MAGA hat to pay "spiritual tribute" to 9/11 victims and was thus discriminated against for his religious beliefs. Instead, the judge cited the state constitution which does not bar discrimination based on politics.
“The purpose of the hat is that he wore it because he was visiting the 9/11 Memorial,” Piatek attorney Paul Liggierisaid in court Wednesday, according to the New York Post. “He was paying spiritual tribute to the victims of 9/11. The Make American Great Again hat was part of his spiritual belief.
“Rather than remove his hat, instead he held true to his spiritual belief and was forced from the bar,” Mr. Liggieri said.
A skeptical Judge Cohen wanted to know about the MAGA religion, the Post reported.
“How many members are in this spiritual program that your client is engaged in?” the judge asked.
“Your honor, we don’t allege the amount of individuals,” Mr. Liggieri replied.
“So, it’s a creed of one?” Judge Cohen asked.
“Yes, your honor,” the lawyer replied.
Judge Cohen tossed the case.
“Plaintiff does not state any faith-based principle to which the hat relates,” Judge Cohen said, calling the incident a “petty” snub.
“The claim that plaintiff was not served and eventually escorted out of the bar because of his perceived support for President Trump is not outrageous conduct,” the judge ruled.
Mr. Liggieri said his client is considering whether to file an appeal.

Political beliefs are not a protected class in Oregon. Sexual orientation is. So they're free to refuse service to liberals, socialists, conservatives, libertarians, whoever.
Bad ruling. All we would have to do is say no Democrats and 97% of blacks and 77% of Jews would be excluded. Wanna see a massive suit if that happened??

I don’t like the chances of the bar, restaurant, hotel or other public accommodation that attempts to do that.
No, you cannot say “colored”, you only need to say “Democrat”.

Are you implying that during the days when the entire media consisted of ABC, NBC, and CBS that we were regularly exposed to a cornucopia of view points, and there were no fingers behind the scenes manipulating what was viewed?
Yeah ok, try and make the argument that it’s political belief and not sexual orientation. Good luck with that in liberal courts.

It was kind of obvious in this case - the guy was thrown out for wearing a MAGA hat. If a gay couple comes in and one of them is wearing a Bernie button then that's all you need. Otherwise you've got a problem.
So can a tavern ban homosexuals , or liberals in NY now?
So Judge, I guess that since homosexuality isn’t a religion, a cake-maker can refuse to bake one for a gay wedding.

Those are protected classes under the state constitution, and in part the federal constitution.
The interesting case will be when a black women wears a “Black Lives matter” shirt into a bar and gets thrown out.
I think it is probably a good thing that we have not passed laws prohibiting discrimination based on political views.
