Parkland Shooting Survivor to Sue Broward School District After Deputy Accused of Failing to Act

Parkland student Anthony Borges, who was shot five times during the Marjory Stoneman Douglas High School massacre, plans to sue the Broward County school system “to cover the cost of his recovery.”

A lawyer for Anthony Borges and his family says the sheriff’s office, the school resource officer, the Broward County school system and the principal at Marjory Stoneman Douglas High School failed to protect students from the teen gunman who killed 17 people and wounded more than a dozen others on Valentine’s Day.

‘The failure of Broward County Public Schools, and of the principal and school resource officer to adequately protect students, and in particular our client, from life-threatening harm were unreasonable, callous and negligent,’ attorney Alex Arreaza wrote in the lawsuit notice on Monday. ‘Such action or inaction led to the personal injuries sustained by my client.’

The lawsuit is likely to be the first of many filed by survivors and victims’ families.

Lawsuits will keep the focus on what could’ve prevented that massacre. There are plenty of laws on the books. Failure of security and asinine school policies that prevented information about the killer from reaching proper authorities are where the failures are.

In this case, there are multiple layers of the failure/malfeasance onion to be peeled. Odds are, this will settle before it gets near a jury.

Yes....that has already been decided by the courts.

But there are nuances to this case that I hope will be included in lawsuits.

Cops may not have to save you but they are paid to perform certain functions in a community.

They arent just given a gun and a uniform and told to wait in the car with the lights on the roof.

They have job descriptions......and these should be the bone of contention.

Where did they fail at the job for which they were being amply compensated?

Good. Bankrupt everyone involved in supporting those idiotic policies. This may be the only way to get schools and local governments to act semi-rationally. Start hitting them in the wallets, even sending a few to prison as accomplices. Then we can end these provably dangerous and ineffective gun free zone policies. Maybe even get them to back off helping illegal aliens too. You aide and abett, you share in the financial and criminal responsibility.

That onion will not be peeled beyond a few layers. Should the Runcie layer be well and truly peeled off, it will expose layers of Chicago-connected marxists... which would in turn be peeled away, exposing a layer of Professor Moriarty types in the Demcorat/progressive matrix. The PTB will cough up the money, the usual suspects will refill the coffers, the ministry of propaganda (CNN/Disney/Comcast) will provide cover, and - voila! - Trump, NRA members, Professor Plum, the butler, and the dog that ate the homework all go back on page one.

Not really. This PArkland case has what we call a continuing student related stand-down order negotiated by Obama, Broward County, and the NAACP .

This is actually an unconstitutional and illegal agreement.So this case has not been decided as you say.

The Coral Gables (?) Police Department had no such negotiated stand down policy and they moved aggressively to enter the school and later apprehend the perpetrator. Broward County Sheriff Dept. was derelict in its duty because they had negotiated an agreement to not enforce the law at the school.This in itself is illegal.As a result the constitutional rights of the students and their parents to Life and Liberty were substantially violated.

I hope that this horrid example of a completely liberal fascist traduced police department is held up to the entire nation and exposed for the Obama led usurpation that it truly is.

The Supreme Court has ruled that the police have no obligation to protect you.

Not the SCOTUS, but a DC Appellate court. However, it does beg the question: What duty does a police officer have in this type of situation? If they are under no obligation to protect an individual, then what is their job and how do they perform said job in this type of situation? If their job is to do nothing more than draw chalk outlines and take statements, then why are they in need of being armed?

Whether he wins or not with the Sheriff’s Dept, he’ll manage to shine a light longer on their incompetence. He’s also after that school district. I don’t see why a good lawyer can’t go after the two parties for PROMISE and its fallout.

With all the public rancor and emotions the lawyers figure they can re-litigate this and win a large payout. I would not want to be a Broward County taxpayer.
