He’ll lose. The Supreme Court has ruled that the police have no obligation to protect you.
Not the SCOTUS, but a DC Appellate court. However, it does beg the question: What duty does a police officer have in this type of situation? If they are under no obligation to protect an individual, then what is their job and how do they perform said job in this type of situation? If their job is to do nothing more than draw chalk outlines and take statements, then why are they in need of being armed?
Whether he wins or not with the Sheriff’s Dept, he’ll manage to shine a light longer on their incompetence. He’s also after that school district. I don’t see why a good lawyer can’t go after the two parties for PROMISE and its fallout.
