The written part aside, morally yes, “consent” SHOULD be present and mutual.
However, without expressed consent the situation is not black and white. Yes, without consent you could have some sort of sexual force going on. You could also have a couple just “falling passionately into it”.
But a law making it rape, without any differentiation as to context? That aspect is stupid and defies human nature which everyone knows can lead couples to just fall passionately into intercourse, mutually willingly, with no expressed consent made.
