He's not running for president.
He is organizing a presidential campaign apparatus so he can defend himself against potential Federal prosecution by claiming that it's politically motivated.
There's a reason this story is hitting the news the day after Preet Bharara, the Federal prosecutor for the Southern District of New York, was fired.

I have interacted with Cuomo on numerous occasions, and the best I can say about him is that he is almost as smart as Joe Biden.
